Visa fee credit?

The US Consulate in Saigon, Vietnam already scheduled my wife for an interview. This is going to be the second one, this time is for the CR-1. The first one before was for the K-1 and she was denied then.

In total, we applied twice, so we paid twice for the visa fee in addition to other fees. The first time, for the K-1, in 2004 we paid US$100 at a DOS office in Saigon, and this time, for the CR-1, we paid US$380, payment was sent to NVC a few months ago. Now my question is that we know that we applied twice so we had to pay twice, then they have to work our case twice, so their effort could be doubled, but just for the same applicant (fiancee before, then wife now) and for the same purpose, which for them is to consider issuing her a visa or not, and for us is to try to get it; so the number of visa is just one in total although we have been applying the second time for it. Therefore, we think we might have some credit for paying twice for the same item; is that right? Which means may we get any refund? Or any discount?

Never heard of anyone getting a refund... you applied twice and each application is delt with on its own... so the fact you had to pay twice would be right....

If you bought a pair of sock and then went back and bought a pair of shoes would the shop refund you the cost of the socks based on the fact the are going on the same foot??? no I dont think so. the K1 and the CR1 are 2 diffrent applications..

You paid for a K1 visa application to be processed, the consulate processed the application, you got what you paid for.

You paid for an immigrant visa to be processed, the consulate will process the visa application, you will get what you paid for.

You are not owed anything, you have no credit due for anything. You paid for visa application processing, not for a visa.

Thank you all. Your replies are very helpful, but somehow not completely satisfactory. Anyway, I need to find out more about this. Then I'll get back to this matter later on if I could come up with anything differently.

Why they denied my K-1? As stated on their letter sent to her in 2005, the reason they denied was that our "relationship has not been established". Then later on, in a letter they responded to my senator's inquiry on behalf of myself, they said something like "... not a bonafide... for the beneficiary to immigrate to the US...", which I don't remember exactly. If you want it verbatim, let me know, then I'll check that letter for you.

This issue does not go away simply because you've gotten married. Be prepared to have to deal with it again, and if a marriage certificate is all you have to add this time you're in trouble.

Concerning your question about the refund for visa fee, I would not even worry about it if I were you. As of now, you have a far more important matter at hand that requires your utmost attention; that is getting your wife over. I am sure you have a valid reason to ask for your refund but why worry about it while your wife and you are still thousand of miles apart? That is just my opinion. Hope you are offended. On the other hand, be prepare very careful for the next interview. Yodrak was right. You must present your case this time with fresh and new evidence. I wish you luck and God speed.

Thank you for reminding me, Yodrak. All I can tell you now is that we think we have been preparing very well, we have tried our best, we have became aware that not just a marriage certificate is the only thing to be added... Altogether, we are so cool right now.

"...while your wife and you are still thousand of miles apart?..." : No, we haven’t been far apart since I first met her, as mentioned somewhere before, I’ve been with her all the time in VN, just went back to the US usually once a year for a short time, 5 to 7 weeks at most for each time, then flew back to VN again solely to be with her, even though living in VN has been a nightmare to me. I would say I cannot afford to stay far apart from her; that’s all. For having been together for a long time, we have saved plenty of significant evidence so far, fresh and new, of course. What else do you want? (Just kidding.)
