Change name to the married one after send in the I-130

Hello guys... Try to make my story short ...

I'm italian citizen my wife is USC and we live in Italy ... we sent the application to the embassy for DCF end of November, with the all set of documentation and copy of unexpired US passport. However they haven't processed it until the 14 of January and in the mean time the passport of my wife expired and she renewed with the new merried name on !!!

I got RFE on Jan 14 asking for copy of unexpired passport, and we sent it to the embassy... I have not heard back from them yet, and I'm not sure of what I should wait for. I'm not that optimistic though, because I know the name change is not good to manage with during the process, however in the checklist is written that they accept document with different name if justified with a valid married certificate.

Anybody has an idea of what could happen and which answer I should expect back.

What name was on the G-325A? I am guessing that you might get another RFE as none of the documents match now. I would email the embassy and ask them. I remember when I got married in Italy 4 years ago, someone at the embassy told me not to change my name until I left Italy as it would cause problems with documents (carta di soggiorno, etc).

Did you wife renew her passport in the US or in Italy?

Also being optimistic, after they approve your I-130 petition, it will take a week or so for the letter to arrive at your house so it could be on the way.

02.08.13 - Moved back to Italy

09.20.13 - I-130 filed at US consulate in Rome

10.18.13 - Received NOA2

10.24.13 - Received packet 3 via email from Naples

11.26.13 - Interview at Naples consulate. Approved!!

She renewed here in Europe. The point is that when we mailed in the application the passport was still valid and all documents are with old name.

Plus they state in the checklist that technically they accept docs with different name if correctly justified.

I really don't know what to expect but I'm prepared to the worse. I mailed already the embassy but no answer yet.

we called embassy this mornign, and I was really surprised to hear that the application has been granted yestarday and forward to the consulate in Naples ... wondering now with which name I shall continue the application O_o

Congrats!!! For the name, has your wife also changed her name with social security? That is going to make a difference when you do the tax returns for the I-864.

Also, as she has changed her name... I would use the married name from now on.
