Hi everybody,

We just got married last week and we got W2 forms from employers in hand today.

Is it possible if we file our tax return together so we may have more evidence for AOS Interview?

Yes, if you both have social security numbers.

You can only file your 2013 taxes if you were married by Dec 31, 2013. Since you married this year (2014), you cannot file as married.

Firstly, check your timeframe. You had to be married in 2013 to claim your wife on your taxes. A week ago would be Jan. 2014...so no. Next, the statement that you both have to have SSN's is totally false. You will though have to file in paper and include a W7, requesting a tax ID number for your wife. This form, along with the tax return is mailed to the Austin Texas address for the W7, they issue the ITIN and forward your return for processing...

So briefly, no chance for us to get our name together on the tax documents?

Our point is that we dont expect any benefits from filing tax returns as married, we just need the proof that we are living together on tax return document.

You can provide "secondary" evidence such as, an updagted lease agreement and/or letter from your landlord if you guys rent. Other than that, letters of evidence from the bank that verifies that you both have joint bank accounts, letters from friends, etc... Your situation is not unusual and should not be problem regarding the AOS petition and process. Best of luck in the process!

So, we were married end of September in 2013. My husband just got his EAD/AP card and DL and is now looking for work but did no work in 2013 in the US. I was planning on filing just for me as normal since he did not work last year, but can I claim him as a dependent for part of the year?

A spouse is never a dependent. You file married jointly, even if one spouse had no income.
