Do we need to get one for our not yet filed AOS if the US citizen has recently been arrested (but not yet convicted) for an offense under the Adam Walsh Act? There's nothing on any of the forms that asks for the US citizens criminal record? Will they check it anyway and deny us as he has been arrested? Or does there need to be an actual conviction in place at the time of AOS?

7 April Biometrics letter received for appt on April 28 (day 21)

They check for a conviction and they will check it at least twice, early on in the filling process and at the time of the adjustment of status. Courts can move slowly and it might be possible to complete AOS before conviction. I'd suggest talking to an attorney.
