Hello everybody.please I need an advise and it's urgent. My first question is that I filed for my fiancee and we have just been approved on the 8th of January.i kept checking uscis website online and it says case has been sent to NVC center since the 13th .my question is should I call them or the nigerian embassy ?

Now my 2nd issue...have been together with my fiancé for 12 years now and we do have an 8 years old son together .he lives in London but he's there legally so I filed for him as if his in Nigeria .i did not include his living in London in the application ..I got to the United States 2004 January ..and I travelled to London that same year and I was pregnant with my son . I dnt go to Nigeria until 2007 with my son and we spent over 3 months ...have been to Nigeria over 6 times since I came to the U.SA and I do spend 2..3 months in Nigeria on each visit ..I definitely travel to London too to see my fiancee .now my fear is if there is a red flag about the dates I became pregnant ? (2 ) we do have about 6 pictures of him and our son (the age my son went to Nigeria ) though they have several pictures they took together but the ages might raise a red flag (3) when should my fiancee travel to Nigeria ,because I don't want him to travel to Nigeria without having the interview date at hand because his scared of Nigeria (lol) we have pictures of him and my family together (dad and mom) my parents lives in America .(4) I have his name on the birth certificate of our son ..we do have call records but definitely his U.K number shows on the logs so it's a NO..NO .( though I do have receipts of paypal for buying cards online ) I have emails,pictures,tax returns but call logs is the problem here ..

Please we need help here ...would so much appreciate any advice in this forum..I FORGOT TO ADD HE HAS A NIGERIAN PASSPORT ISSUED IN THE U.K ...and I heard he has to go to Abuja to get a new one and declare that one missing because of the u.k stamp

The forms ask for current address and last country visited and you did not tell the truth and want to hide that he lives illegally in the UK. Misrepresentation carries a lifetime ban. Start by being truthfull instead of lying.

Why are you afraid of a born in Nigeria male going to Nigeria? Safety or paper issue?

You'll call NVC first until they give you the case number and confirm that they've shipped the package to Lagos and then you start calling Lagos.

As for the other stuff I already got my thread ban of the week so I'll resist commenting and just read the forthcoming responses from the braves.

I don't doubt your genuine relationship but yes you are being ill adviced, be it by a lawyer or whoever and you are risking a lifetime ban of your fiance. You say you have emails and only 6 pics, there is the time / years discrepancy, the lie about a missing passport and the lie about not living in London when the truth would have gotten you approved, these lies likely result in a misrep ban. Whoever gave you that advice does not know what he is talking about. Typical for high risk countries, people thinking they can outsmart the process. Uk and US share data by the way. Sorry but the "system" is too big for you to bypass with the web you weave. You should have a plan B to live with him in Nigeria especially after he won't be able to re enter the UK again legally after he leaves for his interview, unless of course he rigs that too. You are playing with fire and the outcome is not going to reflect the terrible advice you have been given and chose to follow. Sad thing is had you been truthful you could have been approved by requesting an interview in Nigeria even though he is illegally in the UK. If you are put into AP and a field investigation reveals the truth you are done. You are going through the toughest consulate and it is not a cake walk you lie yourself through.

Thanks for your word ...I never said we have just 6 pictures ..I said I can't include all the pictures he took with our son because of we have pictures they took together from few moths old till date because our son only travelled to Nigeria once but lot of times to London .definately we both have tones of pictures together ..with families and friends ..cos it's a period of 12years .thanks appreciate

I echo that never lie to the government because you will always lose, no one hear wants to make you upset or drag you down but you ask for the truth and this is what will happen, you will be found out but you will be banned from two countries the US and the UK, you make one country look bad by having someone illegally and if the US consulate find out which they will as he said the Uk and US are sharing information, the US will also ban, look into living together somewhere else. You should of been truthful from the moment you filed i29f you wouldn't be in the mess

You need to be honest with them about where he has been. As strange as it seems they don't care how long he was illegal in another country. Not being legal means he can't interview there but his records will show he was issued a Nigerian passport in London. Trying to lie to immigration risks him NEVER being able to come to the US. I assume he was never in legal trouble in the UK ( or they would have deported him ) You need to send in an ammended bio sheet for him and fix this mess otherwise you will have to learn to live in Nigeria. For most Nigerians being home isn't dangerous as long as they stay away from the areas with religious fighting and they don't flash wealth like a fool. Someone will have to tell you about getting the police certificate from the UK ( yes you need it if you lived there even illegally ) At this point I would almost recommend withdrawling the current petition and starting again with an hoenstly filed petition. I would also recommend a consulte with a great immigration lawyer ( because your current one is heading you straight to a lifetime ban )

This will not be over quickly. You will not enjoy this.

I understood what you meant. What I meant is that 6 pics, no phone logs and only emails will not do it. I do understand that you have

other pics from London.

Depending on what visa he entered into the UK with, for example if he is on an expired visa and he overstayed there then the US does not

refuse a visa solely on that fact, you would just have to interview in Lagos and can be approved with a London police report.

You have made your case much, much worse by lying. At this point withdraw the petition and start over doing it right because he won't get approved.

Believe that or take your chances and get a lifetime ban and come to regret it. It is easy to figure out his whereabouts for the embassy

and they have a large data base available...emails alone are of course easily traceable. You incriminate yourself by falsifying the information.

It blows my mind how people think they can succeed doing things like this. He will have to overcome his fear of living in Nigeria

because he won't be able to re enter the UK nor immigrate to the US. Think of what you are doing to your family by dishonesty !

I'm really sorry for the situation you're in. I can only imagine his dilemma...he's probably tired of living in the UK illegally since I'm sure without legal papers, he can't work or do anything, not to mention looking over his shoulder all the time in fear of immigration. I'm sure his fear of going to Nigeria isn't really about his safety, it's more the fact that once he gives up his "spot" in the UK and goes into Nigeria, he may be stuck there since he probably wont ever be able to return to UK because of his current illegal status...and then there is no guarantee of the Visa being approved for the US. So I get it..I totally do. It's a shame that you waited until your petition was approved before posing your questions here and asking for advice because you could've restarted the process truthfully a long time ago instead of waiting all these months for an approval only to now be told you should start over. I've seen cases where you'd think they will never grant someone a visa because of all the illegal stays, overstays, etc on their record, but they get them because they come clean and be totally honest. I would have him return to Nigeria (its not the end of the world), then file the new petition with all the truthful facts about his PAST overstay in the UK. Best of luck to you both!
