Hello all,

My partner and I received our NOA2 a little while back with a validity date ending on Feb 26. Can we extend this? My second question is, if this cannot be extended, what happens if my interview is scheduled outside this date? And can I do my medical after my K1 interview?

Medical and interview is up to your embassy.. Different country allows different stuff.

Noa2 validity date will be extended automatically if you are still persueing your petition. You can email your embassy for extension just to be sure.

13th May 2014: AOS (I-485) & EAD/AP combo card
21st May 2014: NOA 1 and biometric letter
11th June 2014: biometric appointment
13th June 2014: RFE received via mail
16th June 2014: replied to RFE
6th August 2014: EAD Approved, AP still in initial review
12th August 2014: got tracking number for EAD
( ) August 2014: Received EAD (I forgot what date I got them but I did receive them less than 5 days from the 12th)
10th September 2014: Interview Waiver received (I wished I was interviewed)
April 23, 2015, we registered your permanent resident status and mailed you a Welcome Notice

I am not sure about the medical after the interview for Sydney Embassy.

Email the consulate and tell them that you will need an extension. They will most likely respond within 2-3 business days asking for a letter from the petitioner to request an extension. There are other things that they ask for in the letter so make sure that you pay close attention to the details. At the end of the email it says that they will contact you if the extension is not approved. That's why I am uncertain whether or not they automatically extend the petition at the interview. It would probably be best to go through this process to make sure that the validity period gets extended but that is your choice to make =]

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I had the same question about extending our valid dates and I emailed the embassy. Here is the response we received:

"To revalidate your petition, please have your U.S. citizen fiancé provide you a letter, requesting that your petition be extended to a further 4 months from the approval date of the I-129F petition. This letter must be dated and signed by your fiancé.

The letter from your U.S. citizen fiancé(e) should state their intention to still marry you within 90 days of your arrival into the U.S. with the K-1 visa and that you both are still free to marry.

Please scan and email a copy of this letter to SydneyIV@state.gov

If your request for revalidation is approved your application will automatically be extended & you will not be notified, however, if it is denied, only then will we contact you within 5 business days to you to advise you further."

There is no such thing as a RIGHT to an extension so they have to tell you what will happen if iis denied. But this looks liike a no brainer for an approved extension. Follow their insturctions and then don't worry about it.
