My father petitioned my younger sister who is 19 years old. late last year, they received the notice to fill-out and send the AOS form after paying the AOS fees, since my father had just been in the US for exactly a year today and held his recent job for only about 7 months, he cannot provide an ITR yet. My question is, is there a timeframe or period for filing an AOS? does the notice expire or forfeits? If yes, for how long? Because my father would want to wait until such time that he can provide and ITR as supporting document. Also, my brother who is an American Citizen and who petitioned my parents in 2012, is planning to be a joint sponsor in case my father's income does not meet the federal poverty guidelines. Does he have to fill-out an AOS form alone and send it or does my father still have to fill-out a separate form as well and send it together with my brother's? Thank you so much and more power!

Your Father has 1 yr to respond NVC's request. To avoid any delay, have your father file his 2013 ITR as soon as he gets his W2 so he can send the AOS. Providing,your father's income will not meet the poverty guidelines since he's only been on that job for 7 mos., your brother can be a co-sponsor.
