Good day everyone,

My USC husband and i are gonna come home to the Philippines to petition my minor kids age 7 and 4 in the US embassy in Manila. I was not married to my kids biological father though they bear their last name on their birth certificate. My husband can only stay for 3weeks since he has to go back to work while i (green cardholder) will stay for 5months in the Philippines. How long does it take for my kids to join us since they are minors and my american husband is petitioning them, i believe a visa is available for them( correct me if i am wrong). Is it faster this way?is there a chance i can get my kids to the US during my stay in the Philippines considering that i have all the paperworks etc.Please advice. We had to make an emergency trip since they were affected by the flooding in Davao. Should we file the petition i-130 now or do the DS260/261(DS-260, Online Immigrant Visa Application & Registration, and DS-261, Choice of Address and Agent), which is the fastest?

As a mother, my children's concern and safety are my number one concern. We were planning on getting them next year to finish their school year but the recent catastrophies in the PHilippines has made us come to this decision. Thank you once again and i hope to hear from you.

2/12 i-130 sent to uscis

2/13 Uscis noa received

3/16 request expedite uscis thru congressman

3/17 office of congressman replied that vermont service center has agreed to expedite

3/24 i-130 approved

3/26 emailed nvc for expedite request no reply waited 30 days

4/9 Nvc received files

4/19contact nvc requesting nvc case number no reply

5/7 called nvc for the case number, finally got it.

5/11email received from nvc about case number

5/9 Expedite requested thru email

5/15 email from nvc will expedite once all documents are in

5/16-aos fee paid/iv fee

5/19 aos /iv fee processed

5/19 got email from nvc request under review?

5/22 nvc emailed same as 5/15

5/20 ds260 completed

5/29 aos documents sent by lawyer

6/4 NVC receive documents allow 30 business days

7/31 got a Freakin checklist coz my lawyer put the wrong number omg so frustrated

8/1-nvc received checklist please allow 60 business days...nice!!!!

9/1-30days is up still frustrated at my lawyer kids would have been starting school by now

9/27-AOS fee changed from "paid" to n/a called nvc right away..confirmed case completed :) finally

10/1-ceac status changed to READY.

10/7-slec advance medical

10/15-interview approved

10/17-visa/passport arrived via 2go. booked US ticket me and my 2 kids yea God is good

10/19-passport req for minors stickers

10/23-arrived in JFk NYC

I would have the husband file an I-130 for each kid before going to the Philippines. Then enclosed a letter that you would like to expedite the case and give the reason why.

You the mother of the kids have a right to make their choice Unfortunately your kids have been in your custody not their biological father

Hence: child since birth up to 8 year old must be in the mother custody

So this would believe that your kids wont take away from you.. so in the matter with your kids to come and join with you, your USC husband can be his/her step father through from his/her mother that spouse of USC husband

The children will each need their own I130 petition. That normally takes about a year from filing to interview. I am not sure if you can expedite based on being there under person choice but you can try, If you lived in the affected area that is another reason. You may want to delay the trip until the petitions are through the US portion of their approvals and then make your trip.

This will not be over quickly. You will not enjoy this.

instead of 'coming home' -

why not file the I-130s to the USCIS lockbox address in the USA?

I see no advantage to be gained for USCIS and IV Processing for 'moving home', whatsoever.

There is nothing in any instructions for I-130 or DS-260 that states anything about 'coming home' to make an advantage for chasing CR-2 or IR-2 visas.

However, there are certain expedites available NOW for beneficiaries in the PI, but your husband must file now and ask for that expedite via cover letter with the I-130 packet, to get that expedite.
