The driver license RFE

Hello all,

I have submitted our i-751 application a week ago, but I did not include copies of our driver licenses. It didn't seem to be a must, but now I'm seeing a lot of people receiving RFEs specifically asking for them.

I am wondering:

- who receives this RFE? Is it typically applicants with weak evidence of bona fide marriage, or is it completely unrelated to the amount/quality of proof sent? I think we provided solid evidence (bank accounts, credit cards, tax transcripts, car title, life/health/car insurance, lease, etc...)

- what is the purpose of this RFE? Is it to prove both live at the same address? Or does it have anything to do with proving the identity of the US spouse?

- should we wait and see, or should we be pro-active and send those copies (I just received the NOA1)? Which brings another question: in CA, the DMV does NOT provide new/updated license cards when a change of address occurs. My husband's license shows his old address. He notified the DMV on due time of his change of address, but like I said, they do not issue a new card for a new address.

We are planning to go abroad in August and I would really prefer to have my new green card for the trip rather than travel with the extension letter (partly because I've had bad experience with airlines dealing with ID documents, mostly partly because I'm anxious by nature), and I understand that an RFE would slow down the process.

I did not submit driver's licenses, since they would show 2 different addresses, none of which is our current address, and did not receive an RFE. We did however, buy a house, buy a new car, open a savings account, open a credit card account, sent monthly statements from 4 different accounts, show joint health insurance, and 2 years of joint taxes. It would have been hard to prove that we didn't live together or have co-mingled assets.

However, it seems like some people get randomly picked for RFE's although many lack sufficient evidence (or a cover letter explaining why). If you think anything is missing, send it so they won't have any reason, beside randomness to send you an RFE.

I would not send anything right now. Just wait for the "RFE" if you think they want more proof.

I don't think we're missing proof, in fact I believe we provided ample evidence. It would just be really silly to receive an RFE for something so simple if they systematically request it!

I am in your same situation! I sent my papers in November 2013 and did not send copies of DL because it was not a requirement and because the addresses do not match anyway (Colorado does the same, update address online but not the plastic). We did send a lot of strong evidence (I think) but I am too a little worried that I will get an RFE, its been over 2.5 months and have not gotten anything though (hope I am not speaking too soon) so we will see!. Good luck to both of us, hopefully we won't get picked on for not sending DLs!

I'll follow your timeline, hopefully you'll get your approval within 1-2 months (if CSC keeps adjudicating ROC at the same pace) without RFE!

I suppose the people at USCIS would not ask for DLs from states that don't issue a new card when people move, but who knows. I also hope that having strong evidence means they won't have to request anything.
