Hi there,

My husband came here on a K1 visa over a year ago. He now has his green card and Employment Authorization Card (EAD). I believe we applied for them at the same time. We are using the EAD right now and noticed that the expiration date is in the Summer of 2014, while the green card is good until the Summer of 2015. I don't remember noticing this or thinking it was a problem before, but now it seems to be a bit of a concern. Does he have to renew the EAD to be authorized to work for the next year that he is waiting to become a citizen? Or maybe it was an error? Any suggestions?

Thanks for taking the time to help!

EAD is a temporary work permit. It allows you to work while you're waiting on your Green card. Once you have your GC it serves as a work permit and you don't need EAD anymore.

My Immigration Journey:

K1: June 2010 - December 2010

AOS: April 2011 - June 2011

ROC: April 2013 - August 2013

Naturalization: March 2014 - August 2014

You have a problem if your EAD card expires before you get your Lawful Permanent Resident card. Surprised the USCIS never requested us to return that EAD card. But ended up in our immigration file.

You are now a LPR, should report that to your SS office and get a new card. If employed, should show this to your employer, also to your DMV.

You may have received a conditional green card that expires in two years. If so, better download the I-751 and instructions, and start filling it out and gathering evidence, mark a date on your refrigerator door and mail it off 90 days before your card expires. If you don't, won't be able to work nor travel.

If you received a ten year card, don't have to do this. Not sure why they call this a Lawful Permanent Resident card, neither card is permanent.

You are suppose to carry this card with you at all times, but so far never checked if you get up at night to use your restroom. When you apply and receive your US citizenship, this is when you are free of this card.

Oh, if you are a male between 18 and 26 years of age, better apply for selective service, can do this on line, if you don't, will be in trouble. You will never be called, but you have to do it anyway or be in trouble with the USCIS.

Should be a brochure that came in with your green card, surprised the number of people that come to this board, get all excited about getting their green card, and don't read this brochure with all the rules you have to follow and just pitch it in the trashcan. Then come here with problems with no solutions because they did not follow the rules.

Also plan on being very very good until you receive your citizenship. And guard that card with your life, cost $$$$ to replace it.

For us, (counting on my fingers) from the date we submitted the full applications, I-130, I-485, etc. Took five months to get the EAD cards, and 13 months for the AOS interview for the conditional green cards. But for the later, the date of the EAD cards was the date they were received so still good for another 7 months.

Forgot about another 450 mile trip we had to take for biometrics for the EAD card, but did use the same photos for the green cards. They never requested the EAD cards back.

Never had an interview for the EAD cards, just for the AOS stage, so what interview are you having March 5th? If that is for you AOS, don't even need an EAD card application nor an EAD card. Should get your green card. We sent in our EAD card application with the original package, were advised to do so due to delays in conditional card processing. Could have also sent in that travel documentation form, but wife and stepdaughter just got here at the time and sure didn't want to go back to their home country. Would have been another $600.00 if we did.

That over a year between sending in our applications and receiving the green cards was a happy time for us and went by very quickly, because we had to wait over a year before we could finally be together. And with those EAD cards, could finally set up bank accounts, and wife could get a drivers' license.
