hello guys! is it still okay to file for AOS if the I 94 is expired for like a year now? if so, is there any addditional fee? I got here through K1 Visa, married the petitioner within 90 days, still marrried and now have a child.

You can apply AOS whenever as long as you got married within the 90 day period for K1 visa and no additional fees needed smile.png

Except maybe for your medical since it is only valid for a year. You might need the I693 now.

It is still ok to file AOS now but your medical examination results from K1 probably has expired after 1 year, so you might need a I-693 by a civil surgeon.

i looked up my files here, I saw the vaccination record or DS 3025 and it says it will expire on 08 2014. I also have the xray CD. These are the only documents I have.

If your I-94 has already been expired for a year, then your K-1 medical would have definitely taken place over a year ago. What was the date of your K-1 medical exam?

Yes it's expired. But the d 3025 is still valid until aug 2014. I realized I need the I 693. Thanks guys!

The expiration date in the upper right of the form? That is an expiration date of the form itself. It has nothing to do with your medical or how long the results are good for.

if marriage date to filing date span >= 2 years , add in the I-130.

I'm certain your medical exam done overseas has expired, so get a new one.

Yes I know, that's why I'm going to the civil surgeon for a new medical.. Do u have any idea about all the immunizations I need?

Take a copy of your DS-3025 with you to the civil surgeon. If you had all the required vaccinations at the time of your K-1 medical, then you probably do not need a lot. If some were just a first shot in a series, then you would need to get the next dose. You will need a flu shot because it is flu season.

If you are concerned about any needed vaccines or immunizations I would suggest that you go to your local county health department and let them tell you what is or might be needed and get the shots there. The county health department is the least expensive place to get any needed vaccines or immunications. Then, take the report from the county health department with you for your visit to the Civil Surgeon. This is what my gal did and had not problems. Best of luck!

What did your wife have to present when she went in for shots? What form of identification did she provide?

My gal had a copy of her medical [report] that was performed when she came to the US. She was an OFW in Hong Kong when she immigrated to the US. As far as ID went, she had her US SS card and an "expired" driver's learner's permit that she used for ID purposes. Finally, again if my memory servies me correctly, she had to get the MMR (mumps, measles, and rubella shot (2 of them) and another shot that I don't remember. Most, if not all, vaccines/immunizations are age based. I hope this helps.
