Minimum Income Requirements for K1

I've read/heard conflicting information. The USCIS site mentions 125% of poverty level, but that's for I-864. What about I-134?

Although the I-134 doesn't explicitly mention it (as far as I recall), it seems to be generally accepted that the same standard applies. It would be counter-intuitive for the consulate to let you in on a lower number and then you find that you can't get a co-sponsor, resulting in AOS denial.

We had the same question when we were filing the I-134 but just to be on the safe side we just went by the 125% ...... If you can manage that now then you know your good to go when you later have to file the I-864

The Foreign Affairs Manual leaves it to the Consulars Officer's discretion to determine what is sufficient financial support to issue a K visa and what is not sufficient as well as what evidence would be required. So there is no hard and fast rule to suggest. However, it is generally agreed that having an income that is more than the I-864 requirements is generally deemed sufficient to meet the I-134 requirements.

Yeah, this is what most people do. Better to have it ready now when you know you are going to be judged at that level in the future.

Depends on how the embassy interprets the requirements. Some ask for 100% and some for 125% They seem to have total control so check the embassy or others who have come through recently. Marilyn and Peter.

Minor point of clarification - the I-134 does not have any requirements. As you explained quite well, the requirement is that the consular officer determine that the visa applicant meets the public charge provisions of the law.

The I-134, if it is used, is one means of documenting a sponsor's financial position to help the consular officer make the necessary determination.
