I am compiling documents for the i-134 but I have realised the only taxes I have from the sponsor (fiances mum) are from 2012. Are these okay?

If you carefully read the instructions for the I-134 you will see that they want proof of current income and there is no income tax forms mentioned unless you are self-employed. Here on VJ we recommend the tax transcripts as you will need the most recent year's tax return for the I-864. So the suggestion is to complete the I-134 like the I-864 so all you have to do is make a copy of all evidence, make a few additions and send it with the I-864 for adjustment of status (AOS). The I-134 specifically asks for item A), a letter from your bank, item B), a letter from your employer, item C) if you are self-employed, a copy of your tax return, and Item D) is in reference to bonds. Look on the bright side: when it comes time to file for AOS you will have 2013 taxes filed so you will then have 2013 and if you want to include the 2012 taxes you can.

If you want to use the 2012 tax transcripts, you may do so. Then when you file for AOS you just need to get the spouse's tax returns as well as the co-sponsor's as the spouse is the primary sponsor for the I-864 and if below the 125% of the poverty level a co-sponsor will be required. But that is down the road a bit.

Good luck,

Dave

If she signs and submits an I-134 prior to April 15, 2014 (tax filing deadline for 2013) then her 2012 is accepted.

*** Wish you would make a VJ timeline so we could see where in the process you are.***
