I am writing here on behalf of my friend's case. My friend got here in USA through CR1 Visa. Her husband petitioned her. They also had co - sponsor which is the relative of her husband.

She has been here in US for less than 2 years and will be applying for ROC soon. My friend and her husband are not working right now. Her husband is kinda sick physically. Therefore, her husband is planning to apply for disability.

Her question is :

Would it affect her status as green card holder especially she got here with co sponsor (relative of her husband) if the husband will apply for disability?

Would she be a public charge?

Would it affect when she apply for ROC?

Simply, the USC can apply for any benefit allowed him. The immigrant is the one shackled with the inability to get certain benefits without repercussion.

Thank you for the reply. How about if there is a question in the form for disability for dependent, if the husband puts her name as dependent, is that still alright?

Sponsorship, the I 864 is a one time event.

Thank you. My friend is really making sure that it won't affect her status and avoiding to be a public charge.

If he is seeking money based on her being a dependent, that would be a no.

Its all in that I-751 form and the instructions that come with it. Immigrant fills that out with all kinds of proof a valid marriage exists. But also loaded with loop holes if it broke up for any reason.

Worse stage of our journey, and this is one time you have to abide by that 90 day rule before your conditional green card expires or you cannot travel nor work. Got a stupid one year extension notice that had to be carried with your expired conditional green card. That expired and had to make an infopass appointment to get an I-551 stamp in wife's foreign passport. If that is expired, can bring in two passport photos and apply for an I-94.

Try and explain this procedure to either your employer if working or attempting to renew a probationary driver's license to your DMV. Just looking at the ROC section of this board, still very long delays with this I-751. One reason why we applied for US citizenship as early as possible, another ton of the same evidence already submitted with the I-751. Some on this board never seen their ten year green card, we got ours in between the interview and the oath ceremony, only to give it right back.

After this is done, can tear up that I-864, for now, its proof you have a valid marriage. Joint is the key word, joint pains is more like it.
