Our K-1 Visa was approved at the end of September. Tony gave his 30 days notice at work and traveled from Amsterdam to Minneapolis on Nov 4. We were married on Nov 15. He got his SSN on Nov 19. We have FINALLY saved enough to file the I-485, have all the required documents required for it and the I-864, and plan to file the I-765 at the same time.

Now I have questions (I can't seem to find instructions that say DO THIS--EXACTLY): When filing the I-765, do we use the category (a)(6), or ©(9)? I'm confused because although Tony's here on a K-1 Visa, he's no longer my fiance. Also, we haven't filed previously for the adjustment of status and it's within 90 days of his date of entry (in regard to the ©(9) category).

And at the top of the I-765 form (not the portion where you Do not write in this block), there is a blank for Which USCIS Office?, Date(s), and on the line underneath that, Results (Granted or Denied -- attach all documentation). What am I supposed to fill in there? We've never applied for this so we haven't been granted or denied anything, and does the question regarding the USCIS office refer to the one we've sent the packet to, or the office that processed all of our K-1 information, or... neither of these options?

Yikes. What a mountain of paperwork. Going through all of this STUFF has given me new insight into issues surrounding immigration and employment....

Help will be much, MUCH appreciated..

It's always C-9 for a pending family-based I-485.

Since he's never previously filed for employment authorisation then your answer to question 11 will be no, and reading through the brackets you will see "proceed to question 12".

Yes. I pour over the guides and read the FAQs... It all gets so overwhelming that it's easy to forget pieces. Tomorrow I'm going to use that guide and go through the documents, make sure everything is signed, all the blanks are marked N/A where appropriate, and do the cover letter with a check-list. I'm missing a couple documents yet--they should arrive by the end of the week, and then the whole 5 lbs of paper will be off (at least, it seems like it should weigh that much!).

VisaJourney and the people here have all been so very helpful. I don't know how we'd have made it through otherwise!
