AOS Tax return..poverty line

Hi guys, someone know how I can find the poverty line about years 2013,2012,2011?

We are preparing documents about Affidavit of support package, and I don't know if we have need a co sponsor.

Poverty guidelines are directly on the USCIS website under 1-864P.

They only go by the 125% poverty guidelines of the current year, as long as you are above the threshold for the current year, you're fine.

thank you Jsumner, but this is for every single year true? not summary of 3years? sorry my english is bad and I don't understand very well..for example what is sponsor's household size? maybe the number of family member live with he?

Read this as it asked three questions. IF you answer "Yes" to all three then you can file the EZ form, otherwise you have to file the I-864 form.

Who cares about 2011 or 2012 or even 2013 for that matter. What can you prove with the most recent paystubs? The only thing the tax returns do is saw a steady increase in salary, hopefully. Think of it this way: the USC sponsor has a low paying job for several years. They all of a sudden realize they need to make more than $20,000 per year. They take on a second job right before submitting the I-864 and after the AOS is approved they quit that second job, going back to the low paying job. The USCIS would want a co-sponsor in that situation. Now let us assume that the US sponsor make just under the poverty level in 2009, then at the 110% in 2010 and then 120% in 2011 and 125% in 2012 and 135% in 2013. That is a steady increase so a co-sponsor is not required. As long as the CURRENT income at the time of AOS submittal is above the 125$ of the poverty level you will be fine. Also notice that the current year's income tax return is required, the last three are optional.

Sponsor's household size is the number of people the sponsor is financially responsible for.

In part 5 of I 864 Household Size --> does it only count for the people who are already in the US and is sponsored by the petitioner? or even the intending immigrant is also counted? For example for F2a, the petitioner has a child? should he put 1 in Part 5 #4 for any dpendent children or 0 because the child is not in the US yet?.. thanks in advance for the reply.

Your household size includes yourself and the following individuals, no matter where they live... Spouse, any dependent children under 21, and any other dependants listed on your most recent federal income tax return, even each individual person being sponsored in the affidavit of support.
