Hello, my name is sebastian. And I am married to a wonderful woman from Thailand. We met online, and went for a movie. We really liked each other and we agreed on a second date. I took her to dance clubs, movies, shopping, walks in the park, early morning hangouts, helped her in her city, we spent the night near the beach, and we moved out together. And since then have been married on August 19, 2013. We met March 13, 2013.(I am a born US citizen)

So she came to the USA. With a B2 visa because she was visiting just for fun as a vacation for about 2 or 3 months. She came at the end of February. And we married after her B2 visa expired.. We are trying really hard to get her a green card.

She has all her paper work ready. And I am just worried for her because I do not know if it is ok for her to just walk in and take the paper work and pay for her to apply for a green card. Because her B2 visa is well expired. Is she eligable?

She also has a 9 year old daughter in Thailand. That we want her over with us. Her biological father has already signed stating he will let her go. We also have all of her paper work.

So what should we do? Is it ok at this point for us to file for my wife? And daughter? Or is it to soon? Or to late?... Please help thanks.

ain't no walk in.

first, the I-130 + the I-485 plus all the rest and fee payments must be submitted into USCIS via USPS or courier. Recheck the guides here, you might have missed something .. And yes, she is eligible.

IMO, the safest time for the child to chase after status will be after Mom has her green card, then YOU would file the I-130, answering 'Bangcock' in Q22 of the I-130. Assume a 4 to 13 month wait until Mom gets her green card.

***** Moving from K1 fiance visa to AOS from Tourist Visa forum ****

You can file for your wife right away, but she will not be able to leave the country for a bit. Follow this Guide: http://www.visajourney.com/content/i130guide2

I don;t think you need to wait to file for the daughter- you are legally her stepdad now, as you married her mom, and so can file the I-130 to bring her here right away. That process will take about a year.

I'm terribly sorry - I've written about 30,000 words this weekend on a project using inferior gear, and my brain is toast.

Interesting she was able to get a B-2. What are her ties to Thailand?

Makes us look pretty silly having gone through the whole K-1 process. Sure saves a lot of time to do it your way.

I think the O P simply stumbled through the beginning of what has occurred. Along the way the exact same system that inflicted so much damage upon so many well meaning people, served him well in a unique situation.

The more common way brought us here with plan for the future that taught us that determination coupled with patience will result in the freedom to begin with a clean slate. I know what is meant by; Freedom isn't Free " and have gladly invested in it.

My husband says it will take Lewis & Clark to get the OP through the next phase. Or Darnell !
