Correct - you cannot apply for AP without AOS. However, it sounds like the OP has been approved for the GC pending the background check. I'm not sure if you can travel on AP with an approved GC but no GC, if you see what I mean. It would also be terrible if your GC were to come through whilst you were out of the country, invalidating the AP and meaning that the POE wouldn't let you back in.

clmarsh.. you are either approved.. or not approved... if the background checks have not been completed then one is not a permanent resident.. one is still an adjustment applicant and the rules regarding K1, EAD, etc. still apply.

In terms of what you can do if your GC is approved if you are abroad, you can either

a) get someone to FedEx the card to you

b) Have someone fax the Welcome to America Letter, or a photocopy of your PR card to you and present this to the officer and explain the situation...

c) Inform the officer that you have been granted PR status since you have been abroad. It should be on their system under your A number.

Regardless, you'll have to use your AP to board the plane...
