EXPEDITE ADVANCE PAROLE

Hello all,

I am new to this forum. But i urgently need advice.

Got my EAD but I am still awaiting the approval of my I485.

I called in ( USCIS Customer Service) last week to request an expedite action on my I131.( My mother in law who i was caring for before i came to join my spouse in the US passed away last month, and on her sick bed, she requested i come home( in accordance to our tradition) to attend her funeral in the eventuallity of her death) The funeral is scheduled to hold on the 27th and 28th of february, 2014.

I spoke with a representative who took all my information and gave a ref. number and asked to wait for 5days for decision.

Unfortunely, i did not recieve any feedback after the 5days; so i called back again. The representative read the response of National benefit centre to me requesting me to provide additional information in order for them to make a decision............. ' Please fax proof of extreme need( or medical documents( not a Drs note), e.t.c.........

These are the documents i mailed with my I131 form

- Death certificate

- Sworned affidavit from my state's High court for death declaration

- Personal letter stating why i qualify for advance parole and why i need an emergency parole

-Burial invite card- stating the funeral date and arrangements

- Pictures showing my mother in law and i while i was leaving with her( i lived with her in my spouse's family house with our 2 boys for over 8years!)

Please i am confused as to what other evidence/document do i need to fax apart from all the ones i mentioned above.

I need your urgent advice please!

I think you will find that your AP is on your EAD card I did read another thread that it was writen on the bottom of the EAD card Somewhere.

No, my EAD card says " Not valid for re entry to US''

Did you file for EAD and AP at the same time? If you did it would be a combo card.

i filled EAD and AP seperately. EAD was approved last year August. i filled for AP last month. Guess the mistake i made was not filling both forms at the same time.

But as it is now, what further evidence do i provide?

I think the documentation you listed above is plenty. Fax them the death certificate and funeral date/plans/invite.

As stated, I think you've provided ample evidence. This is a case in point that you should file for both an EAD and AP, even if you have no immediate plans to work and / or travel, for precisely these kind of exigent events.

Since you already have an EAD then your AP, assuming USCIS approve the expedite, will be a paper one; this version is just as valid as the card, however.

If you get a paper AP. Be sure to call your airline first a verify they will except the paper AP when you want to return home. (back to the US)

A paper AP is just as valid as a plastic one.

I printed off the piece of paper that came with my combo card which states that a carrier should let you fly back to the US and i intend to keep it with me when I travel to show any airline or whatever.

They did get back to the US eventually, but it sounds like it was a royal PITA.

I remember reading that; I made a mental note at the time to never fly Frontier.

Good idea, but the letter that came with your combo card most likely won't overcome poorly trained airline staff.

As adviced, i called the airline they will accept the paper AP.
