Spouse visiting before CR-1

I am a USC getting married to my Canadian fiance in March in Canada. I will be returning to the US. I was wondering if any Canadians had any experience with visiting their USC spouse after being married. We were thinking that after the wedding he would come down to stay with me a month or so before he goes back and we file the papers. If he is honest about the visit what will he need for sure to prove he will be back to Canada? We are just wondering if he should even try to come down after the wedding or if we should just start the CR-1 right away.

My wife is in Canada and just now crossed the border to come visit me. This is the first time she has tried to cross since our application was received on Dec 16. She had no problems with a land crossing at Detroit.

My wife (the beneficiary/applicant) has visited me here in the US 4 times since we started the petition process. Just make sure your spouse brings with them to the border evidence of having ties to their country (open bank account statement, letter of current employment, etc...). They should have no problems getting through.

I was just wondering when my new husband comes across to the US from Canada after our wedding up there...how much he should tell the border patrol if they ask. Like if he were to say he is coming to stay with me a month so we can spend some time together for a honeymoon and such before we file a CR-1. Is there a chance they will just say no? He will have proper backup that he is going back. I am just afraid if he mentions the CR1 that they would think he is an intended immigrant risk.

I have been down to visit my husband several times since our wedding. We just filed with USCIS. Just make sure he brings lots of proof of ties to Canada (lease agreement, employment letter, I bring bank statements too...anything that proves you need to be back in Canada). I have never been turned away as yet.

Always be truthful to the border guys. Only provide them with what they ask for, no more. Look them in the eye and be polite. Works for me every time.

Well we had our wedding this past weekend. :) When I flew back to the US today the border guard asked my purpose of trip etc. He asked what my plans were for my Canadian husband. When I said that we will file a CR1 in the near future he said, you do realize he can't visit until that is filed and accepted. Is this true????? We were planning on my hubby driving down from Canada to stay with me next week for about a month before we start the process. He is allowed to come down isn't he??? I thought maybe the guard was just trying to tell me it would be hard for him to visit as my husband.

He is allowed to seek entry but there is no guarantee that he will ultimately be admitted. The decision on whether or not allow entry is up to the CBP officer he is speaking with at the time.

Congrats on your wedding!

The CBP officer was a little off. Your husband can visit the US, but he can't move there until the CR-1 has gone through. When visiting, your husband should bring evidence that he intends to return to Canada in case the CBP officer questions whether that is his intention. My Canadian spouse has visited me twice since we were married. Once before we filed, once after. He didn't have a problem either time. He was only asked the purpose of his visit and how long he was staying.

As others have said, it all comes down to the CBP officer. Being polite and answering questions directly and truthfully seems to go a long way.
