My fiance and I met 8 months ago and have visited back and forth. We are looking into filing a k-1 visa so that he can come to America and we can marry in October of 2015. I am unsure of this process and would like any help that anyone can give! Should we file for the fiance visa or just get married here, he goes back the UK and then file for the spousal visa? Which one makes more sense?

Thanks!

My experience has been that the K1 visa is the fastest and less complicated(??). Many people have reported to me the the marriage visa can be much longer and can present some unique challenges of documents expiring or not satisfying requirements. The K1 visa was great for us and we beat the average timeline by about 2 months.

Sincerely Chris and Vania (approved 01/14/2014)

How was the K-1 process then? I fill out the application to apply for him and the k-1 and then we wait to hear if they accept the application? Then he goes to the interview with the evidence that we compile? What type of evidence do they look for?

You're asking pretty general question. You may want to start with the visa guides section. it will give you some idea what is required for each.

Basically you have two options:

K-1 You file for your fiance who enters the US. You then need to marry within 90 days. After, you file for adjustment of status and become a permanent resident. 5-7 months

CR-1 You marry in your fiance country. File for your spouse who enters as a permanent resident. 10 - 14 months

Ultimately they require the same effort and information. The K-1 will get your fiance here faster, but you will need to file AOS to get work authorization and a green card. The CR-1 gets everything done up front. the fiance enters with a green card and can start work right away.

I met boyfriend awhile ago we have had some in depth conversations on many different subjects and topics he has talked to his father and has decided to try for a tourist visa so we can meet in person. He is a foreign national and I am a US citizen born and raised here in america. Anyway my question is if and he is approved for his tourist visa and we find that we get along even better than we thought we would can I apply for the k1 petition while he is here on his visit. And then have him finish the process in his home country. Just curious. We met shortly after thanksgiving on IMVU. I know that to soon to get married and so does he thats why he agreed about coming over here for a visit to meet and see how we get on together. Any advice would be gladly accepted. And let me say this I have told him that what ever we do every thing will be done according to the law. I wake up to his picture beside my bed and I fall asleep looking at his picture i know its only been 2 months that we have been talking but it seems like a life time.
