Not filing AOS till after 90 days (split)

Sorry for resurrecting an old post.

But this question is exactly what I wanted to ask.

Does anyone know if this is true?

Will it be a problem if we get married within the 90 days, but DON'T file for AOS before the I-94 date expires?

This is asked about all the time and there are plenty of newer threads here in the AOS forum about this.

There is no deadline. Getting married within the 90 days makes you eligible to file for AOS. Just get it done as soon as possible, since he is out of status when his I-94 expires, and cannot work or travel and re-enter the US without EAD/AP or green card. He should stay away from borders and checkpoints when his I-94 is expired. After you file, he will be in a new period of authorized stay.
