My husband first went to US with a tourist visa overstayed 10 years left,came back to Costa Rica for about a year . Then reentered the US through Mexico without inspection and stayed for another 6. The entire time he was there he was never in any trouble and left both times voluntary.We are now stuck in Costa Rica he has the 9 c ban ...the embassy agrees thats its harsh but its the only catagory they can put him in.Now we have a 10 year ban and are stuck here has anyone heard of this ever being overcome??

nope, the waiver is only for one time entry and living in the US,

when he left after living in the US for 10 years, he automatically had a 10 year ban, he returned without having served the 10 year ban in his country and reentered the US, lived more time here and left

now there is no possible waiver and he will have to wait out the 10 year ban in his country.

Actually a 9C bar is for life, but you can only attempt to file a waiver for it after ten years have passed from his most recent departure from the US.

Timeline

This sounds like a harsh penalty but it was must be done to keep people from re-entering the US after they have been caught here out of status or illegally. He knew he was not supposed to enter the US for 10 years without a waiver, he chose to enter without inspection and in violation of US law after he received the ban.

Try again after he has been outside the US for 10 years.

The second entry through Mexico was the problem. If he never entered the second time, he would be eligible for a waiver.
