Question about tax returns

Hi guys,

another question: i am going to file for the removal of conditions in january. naturally we only have tax returns for 2004 and 2005. is that ok?

Not a problem, you are not required to send I-864 when lifting conditions, that is only needed when you adjusted status.

See the requirements in the I-751 guide:

You can send a copy of 2005 return to show that you file jointly per the instructions.

Um, I think the point is that the only tax years they have joint returns for so far are 2004 and 2005, because in 2003 they weren't married yet, and they won't have filed their 2006 taxes yet. So they already have the returns for all the applicable years and don't need transcripts, the question was whether it will be a problem that they don't have their 2006 return done yet.

It shouldn't be a problem since the form doesn't even specifically ask for tax returns.

The whole point is showing that the couple is filing joinly, just another piece of evidence of real relationship. I suggested transcripts as they are easier to deal with instead of copying tax returns.

Have you seen the new format of transcript? I had to order transcripts for one year because I'd misplaced that file folder ... the transcript was an 8 page long, nearly illegible fax. The actual tax return was far, far easier to deal with (I believe it came out to 4-5 pages including the W-2s and the extra schedules).
