Hi Everyone,

This is my first time posting so sorry if I've posted in the wrong place. I am a US citizen married to an Italian. We are living in London and have been married for 4 years, have two kids and now we are planning on moving back to the States and have gotten all the way through to the final stages of our application but we are waiting for my parents for the Affadavit of Support. The problem is that although we both have good salaries in London they will cease once we leave and we don't yet have jobs lined up as we are moving to a new area. We have some savings but not enough to cover the 3 x s? 5x s? of a family of four 125% over poverty line. So we are asking my parents to be my husband's joint sponsor.

My two questions are: can my parents can use a financial statement in place of a tax return for 2012? They have the returns for years 2011 and 2010 they are still late filing their taxes even after they requested an extension... Also, our kids are US citizens so do my parents put them on their household size or only my husband? So my form would have a family of 4 and my parents a family of 3 - this is also confusing to me as we are planning on moving in with them when we first move back to the States.

Any help would be appreciated. I pretty much know the answer regarding the tax returns (they need to file for 2012) but want to be certain as they have everything else ready. The household size is confusing to me.

The household size is correct. All the American ciizens can go on benefits if needed. Thus the parents are only agreeing to cover one immigrant from seeking means tested public benefits.

I am in a similar boat to you, filing DCF in London. Can I just ask, on your I-864, as the main sponsor/petitioner, did you give details of your job in the UK, or fill it in as "unemployed" as you won't have a job to go to in the US? I understand the process for showing intent to re-establish domicile, just a bit unclear on what info they want on my form...interested to hear what other people are doing! Thanks! :)

It is my understanding that you complete that section if you had any american income during those tax years. I wasn't working in the US or the UK (living in the UK) and ticked Unemployed and wrote $0.00 for all the sums.

I am an American originally from Mississippi. Met my British husband in 1996. Married in 2004. Have lived in the UK for 9 years. We have two children.
