Hi everyone,

So my fiancee came to the U.S when she was 9 years old with her family and they never left the States. They stayed passed their visa and lived in the U.S illegally. and when she turned 18 and 3 months old, she went back to her country and never came back to the states. We're filing for K-1 visa and our interview is next month in Venezuela. I'm curious will this be a problem? because she stayed passed her visa even tho she was underage.

She is still eligible to get a K-1 visa without needing a waiver, since she had less than 180 days of overstay. Only the overstay she had past the age of 18 counts.
