Hi Folks,

My honey is here in the States now. I was wondering which one should I file EAD or AOS or Both. All I care for now is getting SS#. I'd highly appriciate your help.

Since EAD is optional why would you do both (and incur the expense) if she is not urgent to work.

Why are you "hot" for an SSN?

You would need to apply for an EAD to be able to get a SSN as you are a K3 visa holder... you can file for EAD only and do either AOS or CR1 at a later date or you can file for AOS and EAD together...

A SSN is very useful for getting added to bank accounts and insurance.... getting a drivers license and to establish your credit in the US... its just for working...

My employer keep asking for ss#. That's why.

Why go to all the bother of getting a ITIN when you will have to get a SSN anyway.... with an EAD it is also a recognized government issued card and can be used to show your legal presence here as well as allowing you to file for a SSN and many other things...

as a K3 is valid for 2 years it would make sense to get the EAD now then you have the choice to work if you want to... without having to file for AOS.... it also means that when you do file for AOS you already have the EAD and dont have to wait 4 - 5 months to get it....

Only because you can potentially get an ITIN a lot faster..... You can simply go to most Taxpayer Assistance Centers and they will issue it. It is all dependent on what you are trying to accomplish

Yes an ITIN is easy to get but you may well find that banks and insurance companies will not accept it also it would not help you get a Drivers License or state ID... and you would still have to apply for a SSN at some point..

How would they know the difference? It looks just like a SSN as it is a 9 digit number. I cannot remember the last time I was asked to produce my physical SSN card so I simply do not know what is procedure anymore. When applying for a DL does the State ask you to produce the physical card?

Yes they need to see the card and they have to verify your SSN with the SSA system..... so no a ITIN will not work even if it is 9 digits long....

I now here in MA I had to show the actual card to my bank and when you apply for any credit they will verify your SSN too....

Ma and Timi,

If that's the only reason, keep telling your employer that she doesn't have one, that she does not yet qualify for one.

Then when you file your upcoming income tax return, for which you will undoubtedly want to get her an ITIN, give your employer the ITIN.

My husband's workplace doesn't need my SSN. I am wondering if it even has anything to do with taxes? No clue though if some employers may need a spouses SSN.

They don't need it. They want it. Because they don't know how to deal with the unusual situation of a person not having one.

Thank you all!

My employer asked my wife's SS# to add her in my exiting Health Insurance and other benifit. After I explaining them that SS# won't be available anytime sooner, they added her as of 12/21/2006 as a Qualifying Event being in the Service Area. I'm 100% sure that they do not need dependent's SS# to add dependent.

The reason I wanted her to have SS# quicker is for her driving license and add her in my bank account. I live in State of Massachusetts where SS# is required in order to apply for either Mass ID or driving license. I’ll be doing AOS after New Year.
