London Embassy: Person reviewing documents wasn't there!!

Seems the embassy has something up their sleeves, especially now that two months has passed. They must have put you in AP - which can last indefinitely.

Your job is jeopardy by now...? What is your employer's response to this delay?

Got notification on Monday that the embassy has returned my petition to USCIS with the recommendation that it be revoked.

Not what I wanted to hear.

Obviously not giving up yet, lawyer has written to them demanding they give me a reason (they didn't give me one and are legally required to).

The most frustrating thing is there really is no apparent reason for them to decline to issue me the visa. My petition was strong, valid and approved by USCIS. I don't have any criminal record and nothing on my petition was falsified.

My employer is standing by me but there is only so long they can hold out before they have to let me go.

I have never come across an O1 for someone in your situation before, I can guess the reason, but something your Lawyer should be commenting on, he has far more info about your case than anybody here would have.

The embassy must believe that you do not qualify for the visa for some reason (either through missing documentation, or simply being unconvinced by some piece of evidence). Or, could be they were waiting for something from you/your lawyer, which they did not receive in the required timeframe.

The petition being approved by USCIS doesn't mean they approved your visa - it just means they approved that you were allowed to try and apply for one. The final adjudication lies with the embassy.

As Boiler says - you'll have to talk to your lawyer. It's all guesswork from here.

Yes I know that.

I'm just saying that it's generally a formality for a British citizen with a clean criminal record and strong ties to the UK to be issued a visa once a petition has been approved by USCIS.

I have never come across somebody looking for an O straight from Uni, they have all had a body of work to use.

H is more normal in this sort of situation.
