Hello everyone.

I need a little help with my i751 package for my alien husband. I am hoping someone can review my coverletter and offer any advise.

Here is a little background about us, I was born in Uruguay and was naturalized when I was a child and my husband came here on a visa waiver from Uruguay back in 2001. We married August, 2010 and filed for his residency in December 2011. He was approved for conditional status March 12, 2012. I have a daughter from a previous marraige that he helps raise.

Here is my dilema.. throughout most of our marraige we lived with my parents in the their home and all of the utilities were in my parents' names. And now, we just recently purchased our own home, but we have only been their for one month so we do not have a lot of mail at the new home yet. I am trying to create a coverletter that outlines the move clearly and also reflects the relationship he has with my daughter. Here is the outline. Let me know what you think. Any suggestions are greatly appreciated.

Please kindly find enclosed a joint I-751 petition for removal of conditions of permanent resident status regarding my husband, Martin last name. Also enclosed is a check for $590.00.

My husband and I married on date and he obtained conditional residency on March 12, 2012. We are still married and happily living together with my daughter, child name to which he helps raise and acknowledges her as his own.

Enclosed also please find all documents required by this petition and evidence to verify the status of our marriage and ongoing parent-child relationship with my daughter. The contents of this package include the following:

I-751 Petition to Remove Conditions on Residence

  • Filing fee of $590.00
  • Front and back copy of Permanent Resident Card
  • Attached letter explaining change in address (Part 1 Question 22)

Verification of living arrangement at prior address

  • Notarized letter from Sue’s mother attesting to residence
  • Correspondence addressed to Sue from a variety of sources
    • Health insurance explanation for daughter’s doctor’s exam
    • Credit card solicitation
    • Letter from telephone equipment protection program
    • Health insurance solicitation
    • Cable company promotional offer
    • Disney Movie Club membership movie order form
  • Correspondence addressed to Martin from a variety of sources
  • Automobile Taxes
  • Order to appear for jury duty
  • Notice from insurance company
  • Denial letters from credit card company
  • Solicitations from credit cards
  • Promotion from tax filing service

Proof of purchase of house and joint occupancy at new home

  • Statement of home loan from lender
  • Property tax bill for new home
  • Home owners insurance policy listing both names as the insured owners
  • Electricity bill in both names
  • Water bill in both names
  • Internet service bill in Sue’s name for service in new home
  • Best Buy credit card statement to Martin mailed to new home

Records showing comingling of funds and joint accounts

  • 2010, 2011, and 2012 Joint Tax Returns
  • Full year of joint bank account statements
  • Last statement from joint Citi Credit Card with copy of cards, one in each name
  • Last statement from Chase Credit Card with copy of Cards, one in each name
  • Statement from Sue’s Gap Credit Card noting Martin as an authorized user along with copy of cards, one in each name
  • Latest bill from Metro PCS family plan providing service to both

Evidence of family relationship between husband, wife, and child

  • Notarized letters from friends attesting to the relationship
  • Court order removing parental rights of child's biological father

(It provides investigatibe findings conducted by the Department of Children and Families and the court-appointed attorney for the child, describing our home and relationship as a family. It also reveals our plans for Martin to adopt the child).

Copy of health insurance explanation of family plan coverage

  • Copy of auto-insurance cards listing both names as covered drivers
  • Vacation itinerary of flight listing Martin, Sue, and Child as the travelers along with copy of travel stamps from passports
  • Selection of photos documenting the marriage and the parental relationship between Martin and Sue’s minor child.

We request acceptance of this petition for removal of conditions on the residence of my husband, Martin last name. Please advise me if you have any further questions or problems related to this petition.

Add in the covering letter that you both lived with your parents. Also obtain a letter from your parents stating the same and attach it. The outline of your letter looks good.

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

The list sounds very good. My suggestions: I would include new house documents on top of the list (house deed, insurance, etc). I would also suggest that both of you go to local DMV and change your address on your ID or Drivers Licenses and include copy of your IDs showing new address with application.

4/12/13 - sent I-485 package
