New Here, Mailing I-130 Tomorrow

Hi All,

I'm the US citizen finally filing the I-130 for my husband, a Belgian. Ten years of exile in France and thanks to the Supreme Court at last able to come home.

I'm researching the K3 route and at first it seemed the quickest way to go, though I read some things today that suggested not so much. Money is not an issue--we're sick and tired of France--and want to get to the US as soon as we can.

we're in a similar situation (although I'm the only one stuck in Mexico... hubby went back to the US to start a new job and start getting things ready) the K-3 (spouse visa) is not "really" much of an option at this point, as your CR-1/IR-1 case will be "synched" at the NVC stage and the K-3 petition/visa will be cancelled as soon as your CR-1 visa is approved (which happens right about the same time, approval of both petitions that is...)

if France does DCF (direct consular filling) it's sooo much faster, at least here in Mexico at the US Embassy in Mexico City direct consular filling takes from 1 to 3 days tops (for I-130 approval) plus NVC processing. Otherwise you'll have send your i-130 to the US (Chicago or Phoenix) for consular processing and that can take from 5 to 9 months. (which is what we had to do).

if you have yet to be married you'd need to submit a request for a K-1 visa, (fiance) Which lately seems to be the faster way to do it. And when the non USC arrives to the US, He/she would have 90 days to get married and change status within the US.

Hi, and welcome!

I'm no expert on the I-130 process (we just got our fiance visa approved in Brazil last week), but I agree with Norris SF. If you can possibly do DCF, go for it, because otherwise you'll likely be in for a long wait if your petition is processed in the U.S. It doesn't look like France offers DCF, but it appears that Belgium does. You may want to find out if there's a residency requirement in Belgium and if you can somehow meet it, try to do DCF through Brussels. Just a thought, and I'm sure you'll get some other views as well.
