Hello all,

I'm a US citizen trying to sponsor my spouse to get a green card. We're both in the US now and my wife entered the US as a student under F-1 visa. Now that we're married, I'm trying to sponsor her. I was about to send I-130 to establish our bona fide marriage status. But then I found out that you can send I-130 and I-485 (adjustment of status) together under certain circumstances. Does anyone know when you would be eligible to do so? I tried to read instructions from the USCIS website but they don't seem to specify.

Thank you for any help and guidance anyone can provide.

If your spouse is in the US legally (actually that doesn't seem to matter, which still irks me after all I've done to keep my status current to date) then you can file concurrently.
