Hi there, I got a problem with my i 864 for my wife. You see I dont have a job right now because I just came back from the Philippines from my studies. and I petitioned my wife last May and her case is already in the NVC. What do I have to do for my AOS? Can I get a co sponser for her? and do i have to fill out my 1 864 even i dont have a job? Please help me guys. I'm very worried about this. thanks!

Yeah since you are the primary petitioner you have to still fill the affidavit of support even though you will report zero income. If you have filed taxes the previous years, attach them if not just add a written explanation explaining why you did not or we're not required to file income taxes and attach the IRS publication indicating such requirements. Most of the requirements are in IRS publication 501

Now since you have either low income or no income, you have to find either a co-sponsor (someone who lives in the same household as you) or a joint sponsor (so done who resides in a different household than yours). A co-sponsor will fill out form I-864A and a Joint sponsor will fill out form I-864. But depending on which one you use, they should be above the federal poverty threshold limits.

Can I get a co sponser for her? Yes. A US citizen or GC holder can be your joint sponsor. That person's income must meet the requirements based on the number of people in his/her household PLUS your wife. The joint sponsor needs to fill out i864 as well. Follow the AOS instructions for more details.

and do i have to fill out my 1 864 even i dont have a job? Yes. As the petitioner, you need to do so even if you don't have an income or low income.

Please help me guys. I'm very worried about this. thanks!
