Hello all,

So my fiancee (Fiancee as of last week - from the Philippines) and I are looking to marry on her next visit. Now we're aware of the K1 Visa but she rather go the spousal Visa CR-1 route (Long Story). So the plans to marry and after 3 wks she returns to the Philippines.

Now for my question. Here in California, would her tourist visa be ok to establish identification when we go apply for a marriage license? If not what would be sufficient? What would you all recommend? I looked it up but found conflicting info so wasn't too sure. Would greatly appreciate it.

I have a feeling this site is about to become my new best friend. :)

Here is what it says for California:

Both parties must appear in person and bring valid picture identification to the County Clerk’s Office to apply for a marriage license in California. Valid picture identification is one that contains a photograph, date of birth, and an issue and expiration date, such as a state issued identification card, drivers license, passport, military identification, etc. Some counties may also require a copy of your birth certificate.

She can use her Philippine passport for identification.

Ha, not sure if our county courthouse was happy we were getting married or getting a check for 200 bucks, either way, they were very nice. Just wanted to see wife's passport. With me, just my states driver's license.

Really want to find the answer to your question? Just walk in and apply for your marriage license.

Since we were both previously married, had to bring in our divorce papers as well, but could have lied about that, not good to lie. Wisconsin is the only state in the union that I know of that does a two week background check. So we had to wait two weeks before getting it. Couldn't care less about immigration, that you have to check with the USCIS.

Sorry for the late reply. I appreciate everyones input. I finally verified that everyone in the Philippines normally has a passport because they have no official ID out there.

hmh33 : She may have a hard time getting past CBP.

At what point would she have a hard time? I'd like to cover my bases.

Because she is arriving with a nonimmigrant visa and CBP may doubt her intentions to leave the US after marrying you.
