Hello! I am currently working on gathering the information for my 129-F package, but I have a few questions that I hope someone can help me with. (sorry for the legnth)

Back story: I am a US citizen from Minnesota. My Canadian boyfriend and I met online about 4 years ago. We met in person when I began university and after my first year I decided to move to Canada to be with him, under a student visa. So we are and have been living together and attending the same university in Canada for almost 3 years. Now graduation (for both of us) is approaching for June at which point I will be forced to leave Canada and we want to live in the United States. I want him to follow me as soon as possible so we are beginning to work on his immigration now and after he gets the K-1 we will be getting married.

Questions:

1) Question B14 on the 129F form asks where my fiancé intends to live in the United States. Since I live in Canada at the moment, I’m not sure what to put here since I do not intend on renting an apartment until I move back to the US this summer. Should I give them my permanent address (my parent’s address) or what?

2) You would think proof of an ongoing relationship would be easy to provide since we live together, but I’m really at a loss about which documents would be appropriate. The best I can come up with is a copy of our lease, bills with our address and names (there is only one bill that is in both of our names however), proof of enrollment at our university, and photographs. Any advice about other documentation I could provide? Or do these seem sufficient?

3) I realize this is a bit in the future but regarding the affidavit of support—can I just get it signed at the consulate when we go there for the interview (I intend to go with)? Otherwise I think it might be difficult to find a US notary in Canada, and the consulate is too far to make more than one trip (unless I have to).

Thanks a lot! Any other advice about Canada->US K1 immigration would be much appreciated as well.

2) Yes, should not be a problem but obviously the USCIS has the final say

3) Yes, I believe the consulate can perform that function

You have plenty of pictures together, that is good. Pick 5 or 6 pics spread out over your 3 years together. Label the time and place on the back. I would provide evidence of enrollment at the university for the both of you. Copy of student ID, enrollment paperwork, etc. Also letters written to each other is excellent ( it is ok to black out sections that are too personal ), emails, cards, etc can all be used. Just be sure the provide examples spread out over the course of your relationship together. Just look around, there are probably many examples you can use :) .

Your I-129F packet need not be flooded with evidence. Round up what you have and include an attachment stating that you reside in the same household.

You might wish to read the information for your Canadian consulate and perhaps even email them about notarial services. I believe some consulates are cranky about performing this function.

And as you have been resident in Canada for some time, you might wish to investigate Direct Consular Filing (DCF). I don't know if you would qualify as a student, but if you do and you have no problem marrying now, this might be another option for you.

You don't need to prove your relationship in your I-129F petition, you only need to provide evidence that you've been together within the past two years. Evidence of relationship comes at the interview stage. We only sent in a couple of pictures with our petition and didn't have any problems.

Reading what you have said, I think you should concentrate on the support part of the process. As a student you won't have much in the way of financial history, so it is very likely your parents will be required to be file Affadavits of Support, unless you have sufficient assets of your own.

Review the guidelines for support. If you have a U.S. job lined up after graduation, then ask your employer for a letter explaining your employment situation.

Otherwise, I'd say you were right on with everything else.

Thank for the replies everyone! I think I have a pretty good idea now of what I am doing for this first stage anyway. The Affadavit of Support still confuses me a bit in terms of where to get it signed-- I think the consulate will do it but they charge for the service? And can I do it the same day as the interview? I'm not sure, but I'll probably just have to call them and ask.

As far as finances goes, as a philosophy major I doubt i'll have a job lined up for after graduation-- I wish! But I do have quite a bit of money in savings and my mother has agreed to sign on as a co-sponser... So I don't forsee any problems there.

Also I did look into the DCF a little bit, but I think getting married now might complicate my status as a student in Canada (but correct me if I'm completely wrong) and I didn't want to mess around with that. And anyway there are still several months left for school and no huge rush to get my boyfriend down to Minneapolis, so hopefully this process will take the desired amount of time.

Any more advice about this whole process is definately appreciated though. I'm sure I will have plenty more questions in the future, so stay tuned! :star:

Oh I have a quick (kinda dumb) question- Both VJ and the official instructions say to get any digital photos printed at photo lab I think.. but is there any particular reason for this? Would pictures printed on a high quality photo printer from home be good enough? I'm assuming so... but the instructions kind of throw me off.

I high quality photo printer will do fine. It would also be helpful if you could time stamp the photos.
