k1 visa fraud with picture proof

Here is my sad story. I am writing this letter to USCIS. Can sombody tell me what address to send this letter? I also plan to send this to the embassy in her country. Anything else i need to do?

I petitioned Fiance visa K1 for my ex-fiancé. After 8 months the petition was approved and she got the visa after interviewing at the embassy in mid June 2013 . Her visa was good for 6 months until December 2013. After getting the visa, she broke up with me and I was not able to communicate with her further. I assumed that she will let the visa expire or I hoped she would contact me back before her visa expires in mid-December. However, I recently found out that she got engaged with a different person from the USA. This person flew to her village and got engaged with her. She then came with this person to the USA using my petitioned Visa.

I found out about it through Facebook. She had me blocked but I was able to go to her brother profile and saw the pictures. The person she is living with now is called xxx. His facebook profile had publicly posted all their pictures. They live now in New, York at this address:xxx

I am writing to you to lift my responsibility from her. She entered USA using my petitioned visa never intending to marry me or even contact me. Instead she is living with a different person and never tried to contact me.

Below are the pictures I was able to download from their facebook profile. The man with her in the pictures is not me. The engagement pictures are in her house in xxx. The rest are in the USA (California and New York). Those pictures had upload dates between November and December 2013. My assumption is they entered the USA early November.

She will not be able to file for Adjustment of Status regardless whether you withdraw the petition or not. She can only enter U.S. with K1 visa to marry the original petitioner and Adjust Status. If she marry someone else. She could not adjust and will be out of status. She needs to return and file for CR-1 but she will face a lot of issue during her interview.

13th May 2014: AOS (I-485) & EAD/AP combo card
21st May 2014: NOA 1 and biometric letter
11th June 2014: biometric appointment
13th June 2014: RFE received via mail
16th June 2014: replied to RFE
6th August 2014: EAD Approved, AP still in initial review
12th August 2014: got tracking number for EAD
( ) August 2014: Received EAD (I forgot what date I got them but I did receive them less than 5 days from the 12th)
10th September 2014: Interview Waiver received (I wished I was interviewed)
April 23, 2015, we registered your permanent resident status and mailed you a Welcome Notice

OP how did she exit the country (I guess she is free to) but returned on YOUR K1 (or even returned)

isn't the beneficiary required to stay in the US to AOS b4 travelling & if they did ...how does cbp let her

in....could be it was over she found a new beau, cancelled your petition & moved on?

According to OP, the lady NEVER arrived in the US. After getting the K-1 Visa, she just "poofed", disappeared. Then the OP decided to walk away, "assuming" she no longer had any interest in him (which I found laughable and non-believable any stretch of imagination).

Just curious, what would you have done if your fiance blocked all communication with you and was in a foreign country? I dont see what the problem is.

Do you guys know how to read? she got the visa from the US embassy in her country. She came to the USA with a different person using the visa that I petitioned for. As far as i know she is still here living in New York posibbly overstaying her visa. I am assuming she entered the US in November.

She very well may have arrived in the US on the K1 Visa you petitioned for. However, it is kind of a moot point. She will be out of status as soon as the 90 days are up and she hasn't married you. She cannot adjust status with anyone else. If you reported it to ICE, that is about all you need to do and let it go. If ICE decides to act on it, she will be deported (if they can find her) and she will be issued a ban. So, my suggestion is to report it (if you have not already) and then move on with your life.

... that is excellent advice and I think you should do exactly that ... and next time, be wiser ... surely you must have seen that everything was not on the up and up with her prior to filing if you had looked hard enough.

I went to that page. There is information about FDNS but no contact information like phone or address i can send my letter. All I have right now is the ICE phone and email. and the embassy email.

Just to be clear how do you know she came to US using the K1 Visa? When you check the CEAC visa status does it say it was issued and picked up.

She could have traveled here another way you know. Just wondering how you know.
