Hi every one. We need some help. We got married for almost 2 years now this june 2014. Is there any way that my husband can get me while waiting for the I-130 petition because that will take 6-12mos my husband cant wait for that ! please help us thanks...C.

K3? I though K3 is dead. Is the petitioner an US citizens or LPR? The beneficiary can visit here with visitor visa if he already has one with the intention to leave the US later. The beneficiary also need to prove a strong ties with his home country.

Well it isn't june 2014 for another 6 months. You husband could have filed any time after you married and you would have already been here most likely. Why hasn't he filed already it sounds like he doesn't want to file rather than any rule that prevents it. K3 isn't faster

This will not be over quickly. You will not enjoy this.

Try applying now because A LOT of petitions from the Philippines are being expedited.

K3 which is when you apply for I130 and I129F allows you to wait in the US but it is obsolete. Not many use it and not many suggest it now.

You can apply for a visitor's visa and come here but definitely need to prove that you will be back in the Philippines for the interview if you file the CR1 (before your 2nd anniversary) or IR1 (after your 2nd year anniversary).

Things will run around 6 months or so with the expedites for the I130 but I mean that's still better.

Those are your choices as far as I know. :)

If you're living in one of the areas directly hit by typhoon Yolanda/Haiyan, your husband can request for expedite at USCIS. Otherwise, it will be more or less a year before you can immigrate. This is a waiting game so better prepare your mindset. wink.png
