Dear members - My mom (us citizen) adopted a child (12 yers old) in Bangladesh. Mom lives in the US with me, but the child lives in Bangladesh with my sister since her adoption by my mom. What is the process to apply for a adopted child for immigration in this case?

Well the child has to have been living with your mom for the past 2 years for her to be eligible to bring an adopted child over.

So she adopted but for all the childs life they been living with an aunt?

When did she adopt the child.

When did she move to the US.

Was the child adopted legally.

Same process as for a biological child as long as the adoption is final and the child has lived with the adoptive parent for 2 years. Looks like your mom and the kid have lived separately. That won't work. They have to live together for 2 years.

If I understand correctly, the mother adopted the child either while still residing in Bangladesh or after moving to the US, but as a citizen of that country, domestically. So this is not an international adoption.

I myself adopted two children before I came to the US. The immigration process is the same as for a biological child as long as 2 years of legal and physical custody have passed.

If the child was legally adopted before she applied to reside in the US and was listed on the initial papers as a child then yes. If the child was adopted after immigration then the non Hauge rules apply for international adoption. The home study , the paperwork, the definition of orphan. That is why so many people that adopt near relatives after they have secured a green card fail to have a petition-able relationship. Immigration does not want people adoption their relatives as a mean of circumventing immigration law.

This will not be over quickly. You will not enjoy this.

The child has never lived with the adopted mom.

Adopted mom lives in the US.

The child has lived with the OP's sister since the adoption.

The only way for the child to receive an immigration visa is for the adopted mom to return home and live with the child for two years.
