Hello Nice people,

I will be very thankful to anyone who can answer me ASAP.

Our Case :

July-3-2013 - priority date / Submit Form I-130 for Spouse.

Jan-6-2014 - I130 approved.

Jan-6-2014 - USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State.

My question:

How long do you thing will take for the interview, because my spouse(beneficiary)is pregnant in the week 26.

The doctor recommend good and safety for fly is before 28 week.

How the processing of our case can be expedited to get soonest interview day ?

Thanks in advance for any help or information you can provide!

I'm not sure they will expedite based on pregnancy. They only do it for life-or-death cases. However, there is no harm in trying.

It seems you can request the expedite by calling them. Contact details: http://travel.state.gov/content/visas/english/immigrate/nvc/nvc-contact-information.html

Also please bear in mind that your case might take a month or more to even get to NVC after being approved. Call USCIS on 1-800-375-5283 and asked to speak to Tier 2. Explain your situation and they MIGHT help in shipping your case out sooner. I can't make any guarantees.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

What about , another reason to expedite this case is my business? I'm in Bulgaria since May-2013.I have big business loses right now because I'm not there to control and organize the company. The situation is very complicated . I can't back to USA without my wife. If we can't get the visa soon I have to stay here in Bulgaria for at least 6 more months and start looking how to file a bankruptcy for my business in US.

I have been waiting for a very long time for my relative to get an immigrant visa. Now there is a family emergency and I need my relative to immigrate soon to the U.S. Can NVC help me?

Than this would be a financial hardship on the USC. You need to tell it like that. Not her coming here but you needing to leave with your family.

With 2 weeks before your time is up to fly its almost impossible to say you would even get to NVC.

It's taking 4 to 8 weeks just to get petitions to NVC. You do need to be calling them daily.

Here read the NVC filers thread post #1 and #2. Regardless if you are expedited or not you need to get your documents together.

No one is stopping you from flying back to US to take care of your own business, so your situation is kind of self-inflicted.

If your wife gives birth in Bulgaria, you can still file Consular Report of Birth Abroad (CRBA) for your newborn.

Pregnancy in itself is not a valid reason in which they grant an expedite. The question they will ask is "what is the hardship to the petitioner"? Although being separated IS a hardship, it is not one that they consider a valid reason. They will say, as another poster pointed out, nothing is stopping you from going back alone to take care of your business. You have to prove why your spouses presence is necessary to aid you or when her not being there will be a hardship.

Plus, to be honest, nothing in the US govt moves that fast... 2 weeks, I hat to say it, but. Really don't see it happening. I would make for an alternate plan with her giving birth in Bulgaria. But you are of course free to give it a try... But it usually takes up to a month to even get a response, needing a response, then sent to embassy, niter view, visa granted and fly to USA in 2 weeks? IMHO I really don't see it happening... Sorry
