I'm confused, and I think the OP is too, on this thread. I know that a sponsor has to be domiciled in the United States, so if the fiance/e is currently in the non-USC's country of residency/citizenship (or anywhere, really, except the States), the USC will have to get a joint sponsor for the non-USC regardless of income level, yes?

Well no wonder for the confusion; it took 16 posts for the OP to state her situation.

The USC petitioner is always the Sponsor.

If the Sponsor does not have sufficient income, they get a Joint Sponsor.

All Sponsors must be USCs or LPRs, domiciled in the US.

If a Sponsor's income is determined at the interview to be insufficient, that *is* poor planning. The visa decision is held until the beneficiary comes up with the proper financial support. The beneficiary is given an opportunity to get the missing information together, so you could say that there are no "denials" for insufficient finances.

Okay, that sounds about right.

So in other words, yes, it is poor planning to wander into the Consulate hoping you'll get by as far as the financial support issue goes. ;)

Find document I-864P for the year 2006 and calculate for your household size.

Poverty guidelines do not relate directly to the I-134, but to the I-864 that K-1s will be required to provide when adjusting status.

Just because it is time for me to have my little panic for today! :) So instead of having a new thread I will ask it here. Hope no one minds:

When figuring out the poverty line...

does it mean before or after taxes?

does above the 125% mean above the poverty line for one or two people??

Poverty line for one is $ 9,800. For Two it is 13,200.

Minimum of two people, since you are responsible for yourself (if you are the USC) and your fiance. Go up on this number for each person that the USC supports (children, etc). For the cosponsor, they need to make enough for themselves, the USC, and the foreign fiance (so min 3), add on top of this anyone else they support (spouse, children, etc).

Naturalization

mhymers,

That sounds like a 'best case' outcome to me - didn't you write that you were looking for the worst case scenario?

Yodrak

One of my friends that got the K-1 visa, had her visa "denied" in the interview because of the income thing! She thought her fiance's income was enough, but it wasn't and in the day of the interview they told her to find a sponsor and to come back few days later for a new interview... Then, her fiance got a sponsor and she did the new interview and finally got the visa...

thanks Priscila and Christoper. That is exactly what I needed to know.

Thank you SO much! What consolate was that? DO you know?
