My K1 visa pending

Timeline

After the interview... The consular simply said " ur case is pending .. We need to do some administrative processes. You don't need to do nothing . Wait till we contact you ".... I feel really sad ... I met my fiancée on January 2012..Our family know each other... He is 17yrs older than me.. We hav Photos on January 2012. Then he went back to US. We talked on viber & on November 2012, he proposed. I accepted . I want to be with him badly. And we knew that K1 visa took long . So I applied student visa ( silly me ) on 2013 February . I got rejected . Then my boyfriend decided to come to me & we got engaged with ceremony on May 2013. USCIS approved on September2013. We were so happy . He came bak to me again & we did traditional married ceremony . We loved each other very much. Then u went for interview on Jan6 2013. It got PENDING :( I was so sad . Dunno what to do. Please help !!!! How long I hav to wait ? The consular even mocked me like " why u wearing like that on engagement ? " I was wearing simple white dress. We are both doctors . Never married. Help !!!!! Plz

You shouldn't have any ceremonies when applying for K-1. They often mistake those as marriage ceremonies. And you even said that you did a marriage ceremony.

I think you should start looking at the spousal visa.

So why they said pending ? Please... The consular can simply said about it right? I heard that the embassy fear that couple won't married within 90 days arrival to US. We are that willing to marry & even did traditional ceremony. And that leads to bad :( feeling sad... Will the embassy replied exactly my k1 visa is approved or not ?

From what I've read here, if you are applying for a K1 visa you shouldn't get married or have ceremonies. Did you tell the officer interviewing you that you had a ceremony?

I tried to reply this morning but I decided I was too tired and edited it out as I thought I wasn't reading right.

Looking at it now I do see that you did a marriage ceremony? That's not even a good thing. If they even think you've got married, they'll deny you as it makes you ineligible for a K-1, and you will need to file a CR-1.

And, since it seems that you showed these ceremony picture to the consular and he questioned him, that's exactly what he's thinking.

Poor decision making on your part I'm afraid. Really jumped the shark on this one.

Only thing to do now is wait and see if you get a denial or 221.

Getting married with a K-1 pending will probably gum up the works. But nothing to do now but wait for the official response. Worst case, they deny the K-1 and you start work on a CR-1. The spouse visa is only taking a few months longer then a K-1. And bonus for you, you don;t need to file for AOS after you get here, which you would if you came in on a K-1.

I'm afraid this statement speaks volumes. They think you are married and applying for a K-1.

apparently you can't wear an overly elegant dress for an "engagement" ceremony... i agree that you raised eyebrows by showing photos like that but in all actuality you ARE NOT married and have statements saying so within the K-1... Like others have said though you are at the mercy of the officer and you just need to wait it out to see the official response and go from there.

I am sorry to hear this but there is no telling how long the admin process will take.

It can be two weeks or more than a year depending on the case. Did the consular gave you the 221G paper?

I completely agree with the VJ members here, that ceremonies like the one you had may trigger denial because you are considered as married (though it was an engagement party) while you have K1 visa process pending.

You might wanna regroup with your fiancee and discuss the possibility in taking the CR-1 route.

Yes .. He gave me 221g paper and tick the box that said " under administrative process ".. :( we are applying fiancée visa coz we want to be together quickly like every loving couples want :(

You might want to start getting the paperwork ready on a CR-1. I don't know if AP is going to bode terribly well for you.
