Hi! Im a Filipino citizen and Im going to marry a Fil-Am citizen this month. I need to renew my passport on Feb with changes due to marriage such as the civil status and family name. I just have few questions regarding the passport application:

1. Do I still need the CFO certificate which is a requirement for those who are married to a

US citizen, or I can skip that since he is Filipino citizen as well?

2. Do I need to present ID cards which bear my future married name or just my old PRC, BIR ID, and Drivers license with my maiden name on it?

I need your advise. Thank you in advance!

You need to attend CFO because once DFA sees that your husband has foreign citizenship, it will be a requirement.

Regarding the ID cards, I think you can still use the old ones and in ADDITION you must present your original NSO marriage certificate and birth certificate.

What I did before is, I brought my voter's ID (maiden name), new driver's license (married name), original NSO BC and MC.

It would be nice if you can renew your DL into married name, at least you have an ID that bears your married name aside from your passport (and I think it's the fastest ID that can be renewed wink.png )

Did you get affidavit of legal capacity at the embassy to get marriage license? Did he indicate in your marriage contract that he is Filipino- American or just Filipino?

Yes he went USEM to obtain legal capacity to contract marriage. Yes he indicated he is a fil-am.

Is he dual citizen?

Yes, he is dual citizen (Filipino-American). When we went to the Local Civil Registry to get a marriage license he just indicated Filipino (Not Fil-Am) on the application form. He showed them his nso birth cert that he is born here. But we would like to have it indicated in our marriage contract that he is Fil-Am just so we wont have prob at the USEm when he files for petition. I hope the judge would let us put Fil-Am there..

Being a dual citizen couldn't he get a CENOMAR?

Hi! He has a CeNoMar. We gave it to the local civil registrar and they accepted it. We have now a marriage license but it only says Filipino in his citizenship, not Fil-Am.

You should have put FILIPINO-AMERICAN in the application for marriage license if he holds both US and Phil passports BUT if he only holds a US passport it should be AMERICAN only. Maybe you can have it corrected with the LCR. Show proof of US citizenship plus the Legal Capacity to Marry.

Not putting American in the marriage certificate might cause issues when he files i-130 petition for you.

Normally when you want to put fil am on the application, they would ask for legal capacity from USEM.Whatever you put on the marriage license application it would reflect on your M/Certificate. But it wouldnt matter if it shows filipino or Fil Am/ US citizen on the M/C. Ours had a typo, they put Filipino for my husband instead of Fil-am. We consulted USCIS and we were told it wouldnt cost us any problem since he has a dual citizenship and it was just a matter of proving he's a U.S Citizen here in the U.S when he submit the petition.

Same situation with my brother in law. It show's filipino on the M/C but didnt have any problem at all.

Thanks! I was able to process my passport yesterday at the DFA and they did not ask for CFO. But it says there in the link that I need it at the immigration too so I will still get my CFO when I get my passport and hopefully my VISA too. Thank you so much!
