Pardon - I thought you wanted to stop the process? Best way to have done that would have been to withdraw the visa application during the interview.

as to your questions - you give them exactly what they ask for.

You might get some 'slack' from the IV Unit showing his 2013 tax data. Maybe.

We talked and we really want to be together...... i really love him..... maybe we are just stress out with the situation...

As I mentioned to you in an earlier post, as long as his 2013 tax return shows adequate income there should be no issues. Being you didn't reschedule the interview so that you had the 2013 return in hand you will need to wait until your fiance gets a copy of this tax return and W-2 to you, luckily he can simply email it to you.

You saved no time by not rescheduling as you now have to wait for the 2013 tax return and W-2, then wait for the embassy to get it and then review your application once more.

I just have to ask you one question.

Do you think it a wise decision to move to the US to live with someone who earns below the poverty level?

(It looks like you are coming on a K-1 VISA. That means you will not be allowed to work until you have gotten married, and received work authorization. It could take 3-6 months or more after you arrive.)

I am not judging you, I am simply posing a reasonable question.

It's possible to live with friends or relatives (namely the joint sponsors, but not necessarily) until they get on their feet. I would rather do that than spend another year apart.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Thanks Hank. The consul told me my application is fine but they wanted my fiancé's 2012 income tax return( where he didn't reach poverty level). He will file taxes as soon as he can and i hope 2013 taxes will be enough plus his paychecks and we will pass his employee letter again.

Do you think they will look at his 2013 taxes than 2012 this time?

Me and my fiancé were living in while I'm in the US last 2012. He is only 20 years old that time. But because I had a job there too under j1 visa, money isn't a problem at all. He work at the forestry part time during summer. October that year, he found a regular job. he is earning 2500 a month with his regular job and during summer as a wild land fire fighter he can earn 4500 in 16 days or 20 days of working..... basically we just need more documents saying that he is earning above poverty level. My fiancé just turned 22 today and he will work hard for the next one month to show his paychecks.

Yeah, that's a great idea. Uproot a Filipina from her home and everything she knows and have her move in with a fiance that is not earning above the poverty level. That will be one heck of a honeymoon with mom and dad or other relatives on the other side of the bedroom walls. Great idea! Seems like a terrific start to a marriage made in heaven.

Did they ask for the 2012 return or last years return. If they asked for the 2012, you should provide it. But as you say the 2012 does not meet 125%, you will also need to provide 2013 return and proof of current employment. Employment letter, pay stub etc.

If he files as soon as he gets the W-2, you should have your returns early Feb.

you know what guys, instead of helping me you are depressing me. But thanks for your opinions, as what i have said my fiancee is earning above poverty level already. the only problem is his 2012 taxes..... right now he is earning 26 thousand and that is poverty level. Since he was here last 2013 february and october 2013, he missed two months work but still he manages to cope us with his not sufficient income during 2012.

And for your information, i was in US last 2012, we are living together in the US which I can strongly say that we are living just right (i have a job that pays me well and i graduated college with bachelors degree)we have apartment, a car, he owns a house in north Dakota and he just turned 22 today. What do you expect from a 22 year old guy? He is doing his best to get me back because it is not fun to live alone in his apartment.

How can you say that 2500 a month on his regular job and 4000-5000( 16-20 days of work) isn't enough to live in the US?

We maybe stress out so much with the papers, we fight about the papers but I'm happy to say we always fix it just like anybody of us here. We are not yet done with the visa, we don't know the decision yet but we are still hoping for the best.

We have been together for 1 year 8 months. Living together in our apartment for five months in the US and he visited me twice here in the Philippines already. His family is treating me like their daughter since he is the only son, they are willing to help but co sponsors are not accepted. When he knew about my 221g yesterday, he cried because he doesn't know what to do to get me back there. We will try his 2013 taxes, its above poverty level and hope it will work out....

yes thats the one they were asking his 2012 taxes. His 2013 is coming and as what Hank was saying it could help us. We have his 2 employment letters and his current paychecks we will send that too.

We have our own apartment and I stayed there with him last 2012, he owns a house that was given to him by his grandpa so why are you saying this nonsense stuff which cant help us?I am asking for help not judgement.

Again, he is just turned 22 years old, he didn't make enough last 2012 but he did make above poverty level this 2013 and he is a regular employee.

We can rock the walls of our own apartment and his house, so why should we bother about his rent house lol.

yes, they are asking about his 2012 tax returns (but he only made 8thousand) because he just work summer that time.

This 2013 taxes he will be making 26,000 already and thats above poverty level. and we will be passing that together with his 2012. Hope they will consider his 2013 taxes.
