hi! i receive 221g today..... two of the requirement were 2012 tax returns and w2....

here's my question: My fiance didn't earn that much in 2012, so his tax return is below poverty level. Do you think his incoming 2013 tax return which he actually made it above poverty level will help us? or im i still in trouble with 2012 tax returns

Pardon - I thought you wanted to stop the process? Best way to have done that would have been to withdraw the visa application during the interview.

as to your questions - you give them exactly what they ask for.

You might get some 'slack' from the IV Unit showing his 2013 tax data. Maybe.

Don't get to upset about recieving a 221g for not providing 2012 taxes with the I-134. Thats normal because submitting your previous tax year returns is a requirement. If they are low that does'nt mean your going to be denied.

It appears they are asking for proof of income as to the W-2s. 2013 taxes are not due yet but if that income is above poverty lines that is what can save you. Submit all you can of 2013 income and a completed tax if posible. Include check stubs year to date for 2014 as well. This will satisfy what the 221g is asking for.

thank you so much i hope it really works..... I feel so sad right now because we really miss each other, we are just too stress about this because they require 2012 w2 and tax returns of my fiance but he didnt meet the poverty levey....

hope 2013 tax returns and pay stubs will give us hope.... anyways what are evidence of sustained current income?

I say wait a bit, get the 2013 tax year stuff done, submit it prior to the expiration date of the 221g submission date.

Most likely. But answer the 221g with what they asked. Submit 2012 Taxes as well. (even if they are low)

They are more concerned about financial stability more recent to date. Which is where 2013 income is above 125% of the poverty lines.

im worried right now because the main requirements are 2012 income tax return and w2 (fiancee didn't meet the poverty income) and evidence of current sustained income (what is it).....

Im really hoping and praying 2013 w2 and income tax return will save us both....... when will he get his 2013 income tax return and w2? any ideas? help me please.....

As what I understand current sustained income is the income of the USC for the past 6 months prior to submission of any petitions ....we submitted summary of my USC husband 6 months income June to Novemner 2013 with attached paystubs when we submitted our aos last month.

We received my husband's 2013 w2 last weekend mailed by his employer to our home address ...we plan to do his 2013 IRS tax return end of January online.

thanks for giving me some ideas....I'm planning to use 2013 tax return to to suffice the needed 2012 tax return requirement..... and a letter from my fiancé that states he didn't make that much in 2012 because he is just a temporary worker during summer...... I do believe we can make it and we are strongly hoping for the best......

If you withold a document they want to see, they will think you are hiding something. Actually you are hiding something, but it won't work.

Can you get a letter from your employer that your work there is steady and that your anticipated 2014 income will be similar to your 2013 income? That will show that although your 2012 income was light, you now have a good job and expect to have it for the foreseeable future.

Tax return and W2 (which is a part of tax return) will not save you. You need pay stubs and proof of employment, tax return alone is not going to be enough.

W2s are issued by employers by end of January, he will have complete tax return whenever he decides to file it - this is up to him and nobody else - assuming he has all the supporting docs (W2s, 1099s and so on).

I just have to ask you one question.

Do you think it a wise decision to move to the US to live with someone who earns below the poverty level?

(It looks like you are coming on a K-1 VISA. That means you will not be allowed to work until you have gotten married, and received work authorization. It could take 3-6 months or more after you arrive.)

I am not judging you, I am simply posing a reasonable question.
