Timeline

We tried to get a state ID from the Nevada DMV. DMV said we can't because of the expired visa in the passport and said we need a extension letter from USCIS. We are currently waiting our TB results from the Nevada health dept. and have not submitted our AOS. We have SS# and marriage cert of course, any way to get a ID or a extension letter from USCIS?

Not until you file for AoS. If your I-94 has expired then you are illegally present in the US and could be detained by ICE.

The I-94 is not expired, its the 90 day fiancé visa that's expired. Dmv still would not issue us a ID card???

The Visa is a one time entry document so that expired as soon as it was used.

The I 94 issued on entry was for 90 days.

The visa expired the day you entered the US. The I-94 is the one that's 90 days. Even if the I-94 is still valid, most states won't give an ID card on just that. They require the EAD or green card. Even if they did give you an ID card it would expire the day the I-94 expired. There's nothing you can do except wait until you have the EAD or green card. There is no such thing as a visa extension letter from USCIS.

They will not issue you a state ID or Driver's License unless you have your EAD or green card. I just applied for my state ID last week, since i still don't have my GC (still waiting for it), i used my temporary I-551 which is valid for 1 year, marriage license from NSO, SSN, and my husband pay stubs (proof of residency). You have to get your EAD and then apply for your adjustment of status.

It actually varies from state to state.

Some states have even begun issuing licenses to illegal immigrants, although those "driving privilege" cards (as they are usually called) are not valid for use as identification.

We tried to get an ID card while she was still on the I-94. They told us to come back with the Biometrics appointment letter which we did. We got the EAD about a week after we got the state ID. (WI)

We're going to the IL DMV tomorrow, for a learner's permit and state ID. When we were there 2 weeks ago, we were told she needs unexpired

Passport, I-94, and 2 mail pieces with her address on it. Social Security card is 1, I-797 is the other.

For a K-1 visa holder, this order is wrong.
