Making Same -Sex Illegal how will you get approved

Okay I am really curious and wanted to find out how exactly the same-sex immigration works in countries where its illegal. I ask because Nigeria's president has just made same-sex marriage illegal. Punishable for up to 14 years in jail (really its death over there if caught).

So everyone is always saying "The CO go by the local customs and laws". So if its illegal in the Beneficiaries country does it matter? Or is it about the state the person moves too?

The consulates act according to the laws of the US. Nigeria can't prohibit its citizens from getting married abroad, so it will not affect K-1 applications.

I always wondered like The Muslim countries and how that's forbidden and could basically get a person killed. Okay good to know thank you Gegel.

What happens if the Consulate employs locals in the visa offices? I would think they would have access to that information before the interview, so I think this is a loophole that will be exploited. No telling how much money a ( local ) embassy employee could charge to keep your info on the down-low. It would be a very long and dangerous wait for the interview and then you have still got to go through customs or border security to leave the country.

Education is what you get from reading the small print. Experience is what you get from not reading it.

Good point. I think applying in a backwards ####### place like Saudi, might get a person killed

The laws of the US is no Felons can enter into this country. If same sex is illegal then they are admitting to being felons.

They will just give them a humanitarian visa since they are being or will be persecuted in their homeland! If this does become reality, you will see a massive surge in same sex applications in every country that is considered a high fraud country.

Education is what you get from reading the small print. Experience is what you get from not reading it.

An act of Congress is required to give humanitarian visa's and doubt that will happen. Besides not every state has legal same sex marriage. It needs to become established law in this country to allow it from others. Our laws says no Felons can enter this country.

They will just give them a humanitarian visa since they are being or will be persecuted in their homeland! If this does become reality, you will see a massive surge in same sex applications in every country that is considered a high fraud country.

In the context of a K-1 the laws of the US apply, i.e. it is not a felony in the US, so there is no conflict there. You should be OK.

Not for K-1 and IR/CR visas no act of congress is necessary. The USCIS recognizes same-sex marriages for the purpose of these family based visas. Google the SCOTUS decision on US vs. Windsor from last year, on this subject.

Check out the K-1 forums. There are several cases reported there of same-sex couples and approved K-1 visas. It has been happening since last July.

I agree with you, but this country is not really renowned for it's adherence or enforcement of current immigration laws.

Check out the K-1 forums. There are several cases reported there of same-sex couples and approved K-1 visas. It has been happening since last July.

There is one ongoing now in the PI forum. Last I read, they were waiting on NM to rule that it was ok to marry there before they applied for K1. Not sure if they are moving forward just now.

Huh? DOMA got repealed, the bits on same-sex marriage 'legality' and

USCIS and the DoS handle intake and interviews already already.

For K-1 visas, the interview is a no-brainer.

For CR-1 visas, is best to get married in a country that allows for same-sex marriage.

Let me know when they give the first same sex fiance visa.
