K-1 VISA EXPIRED! URGENT HELP PLEASE!

HELLO EVERYONE. I AM SO SAD. MY FRIEND JUST CALLED ME FROM NEVADA TO INFORM ME THAT THE K-1 VISA THAT WAS APPROVED AND GIVEN TO HER CUBAN FIANCE (WHO IS STILL IN CUBA) HAS EXPIRED.

HERE'S THE WHOLE STORY: HOPEFULLY SOMEONE CAN HELP ME GUIDE HER AND HER FIANCE. PLEASE, IF YOU HAVE ANY ADVICE EVEN IF IT'S JUST A LITTLE, I SINCERELY BEG YOU TO SHARE IT.

I TOLD HER TO EMAIL THE NVC IMMEDIATELY, SO THIS IS WHAT SHE JUST SENT THEM:

Dear Sir/Madam:

My I129F fiance visa petition approval was sent to the US Consulate in Havana Cuba, long ago.

My fiance had his interview at the Havana Cuba US Consulate's office and was approved.

Since he worked in one of the branches of the credit and commerce section in a Bank in Cuba he had to request to be released from The Ministry of The Central Bank of Cuba.

He was released, but unfortunately this process of release took about 6 additional months therefore I sadly express that his VISA became expired. When we communicated this to the US Consulate in Havana to attempt to renovate the expired VISA they explained that they would contact my fiance soon since our case had been sent to Washington to be processed again for my fiance to be granted a new VISA. The US Consulate office in Havana called my fiance in October of 2006 to let him know that they were still waiting for a response from Washington. They asked him to be ready for their call since they would be calling him as soon as they received his paperwork from Washington, but he still hasn't heard from them.

I write you with the most sincere heart and in search of guidance. Please guide us in regards to what our next step should be in order for my fiance to be granted a new VISA. You are our last hope. We have called the Havana Cuba US Consulate but they explain they are still waiting on Washington to send the paperwork over to them so that a new VISA may be granted.

I believe they need to start again, the original visa has expired so they need a new one.

Timeline

Has the US citizen requested any assistance from Congressperson or Senator? If not, I would certainly start there so that they can check on the status with Washington before beginning again - especially since they mention as recently as October that they should be hearing something about their status.

I have read of situations where the Embassy has extended the K-1 for various reasons, but I believe it's up to their discretion on whether to do so.

Has the US citizen requested any assistance from Congressperson or Senator? If not, I would certainly start there so that they can check on the status with Washington before beginning again - especially since they mention as recently as October that they should be hearing something about their status.

I have read of situations where the Embassy has extended the K-1 for various reasons, but I believe it's up to their discretion on whether to do so.

AFTER READING YOUR RESPONSE I CALLED MY FRIEND IN NEVADA, SHE IMMEDIATELY PREPARED A LETTER FOR A CONGRESSPERSON SHE ABSOLUTELY LOVES, SO I HOPE THAT HELPS! SHE'LL BE SENDING IT OFF TODAY.

Have you tried going back to the embassy and explaining the situation to them. I have read something about this on one of the USCIS sites but can't find the link right now. It said something to the affect if the beneficiary cannot execute the visa within the defined time limit the embassy can re-issue the visa for an additional six months. I hope, for your sake, this is possible. Good luck :thumbs:

Your friend should have a consultation with an immigration attorney, one who has some experience with Cuba if you can find such an attorney. (Something she should have done long ago - did she?)

I'LL LET HER KNOW MAYBE SHE SHOULD FLY TO CUBA AND GO TO THE HAVANA EMBASSY WHERE ALL HER CUBAN FIANCE'S PAPERWORK WAS FIILED AND THE VISA WAS GRANTED. MAYBE THAT WILL HELP. I DOUBT SHE'LL BE ABLE TO GO THOUGH BECAUSE US LIMITS VISITS FOR AMERICANS SO SHE'S KING OF POOPED OUT OF LUCK ON THAT END. :-(
