The date your GC was issued start counting. So you are married now. Than count 21 months from issue date if still married to USC you can start filing (90 days from the expiry of your GC) actually. Many run into Removal of Conditions and Citizenship almost overlapping.

Look on your green card for the date next to "Resident since". If I'm reading your post correctly, that's 8/30/2013.

If you're married to a US citizen, the earliest you can apply for citizenship is May 31st, 2016 (add 3 years to your "Resident since" date, then subtract 90 days), provided you meet all the requirements. You would have to stay married to the same US citizen, among other things.

If you're not married to a US citizen, you'll have to wait 5 years instead of 3, so your eligibility date would be May 31st, 2018.

There are several requirements for becoming a USC. Have a look at this document for the requirements for becoming a USC. First you must be a LPR for at least 3 years AND married to a USC spouse AND that spouse has been a USC for at least 3 years. Otherwise it is 5 years. Then there is the time spent in the US requirement (physical presence) and the time spend in the USCIS district requirement. Based on the information you supplied, you can file for USC 90 days before 8/30/2016 which is June 1, 2016.

Good luck,

Dave

When your daughter is born, because she is born on US soil she is automatically an American. For the Vietnamese citizenship you will have to check with your embassy. They will give you the best info about that. I have a daughter and she is dual citizen. she is born here in the US that makes her a US citizen and according to my home country's law, because she is my daughter she is a Tunisian by birth even if I didn't report it to the embassy but I did anyways. I don't know how it goes with your country. Good luck.

Remember two if you have a 2 year green card, you will have to remove conditions 2 years minus 90 days. That's before getting citizenship. If you don't do that you might loose the green card. So make sure about it, if you have 2 year green card you file I751 in 2 years minus 90 days. If you have a 10 year green card you just file for citizenship 3 years minus 90 days as long as you are married to your husband. Good luck.

I just did this for my son in Vietnam. Were do you plan on having the baby? If it's in Vietnam I can tell you exactly how to do this. Inside the US it would have to be done through the Vietnam embassy for VN citizenship. I'm not sure how this works as Vietnam doesn't recognize dual citizenship. They may make you sign a bunch of pieces of paper declaring the baby's citizenship is Vietnamese signed by both parents to issue the documents.

I won't blame you if you didn't want to have a baby in Vietnam. We had our son a Western baby hospital in Vietnam; it was good. My wife's brother just had a baby in Vietnam at a local hospital and the hospital wouldn't let them see the baby for 3 days after birth. So much for that all important bonding period. I was completely shocked by the whole situation. The baby wasn't sick; we just couldn't see the baby. In the end I gave the hospital staff tea money to see the baby and speed up the discharge once I learned the baby was fine.

Do you plan on practicing 30 days of confinement after the baby is born? If your husband is a westerner fill him in now. I had no clue about this custom and was unprepared for the adjustment. The wife and her family assumed I knew about it and got mad at me for feeding the wife the wrong things and bathing her in warm water. It drove me nuts.

Hi there. I just did some research at uscis.com about becoming a US citizen and I am not sure if I understood it completely, so please help me out here. It says that I can apply 3 years from the date I became a resident. Does that 3 year includes the 2 year Conditional permanent residence? For example, I became a conditional resident 01-01-12 and it shows that I'm a resident since January 1, 2012 on both my 2 year and 10 year green cards, does it mean that I can apply for Citizenship January 1, 2015 or 90 days before that?

I know there are previous postings on this thread already, but sometimes things are just so confusing that I need extra pair of eyes to make sure I got them right. Aside from that, a lot of people that I know has been telling me that I've to wait for 2 years after I got my 10 year green card then apply???
