Dear all,

Long long story short: my fiancé, who's an American citizen, got married long time ago (2005) with a Nigerian woman but it was just an arrangement so she could stay in the US and have a green card. He did it because she was a family member of his step father and at that time, he didn't know how this could affect his future relationship.

The procedure for her has been on hold since then because he couldn't help her anymore for many different reasons (would be too long to explain here). So she didn't get the green card but she's still in the US.

Now he wants to ask for the annulment of marriage. If he can't get it, he will get divorced. The problem is that he was in such a hurry to start our K1 process that he just sent out our package for the K1 visa stating that he's single.... dry.pngshocked.gif

I know this will tremendously postpone our application but I'm afraid I can get the visa denied because of all of this mess.... Like how will the USCIS react about all of this regarding my visa?

What can we do to make things better here??

If anyone ever experienced something similar, or have any beneficial inputs, I would appreciate the help!

He misrepresented documents saying he's single in fact is not and there is a possibility that your I-129F could get denied. Both of you are legally free to marry before filed I-129F, one of USCIS requirements, unfortunately, your fiance can't provided. I hope some senior VJers here can shed some lights for you. This is a very, very serious issue, I would highly recommend a consultation or two with immigration lawyers.

He needs to withdraw the current K1 petition asap, If he withdraws now, he can file again once properly divorced. If they find out he lied, that is immigration fraud and will cause huge issues.

In the USA, annulment is practically impossible.

Your fiance already comitted immigration fraud with the first women. It;s fine you don;t want to go into details here, but he needs professional legal help to get that sorted, because it WILL impact your ability to get a visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

While all you stand to lose is any immigration benefits you might gain if you obtain a visa he could, note I say could, be looking at criminal charges. He lied on official government papers and it looks like he might be bringing women here for immigration purposes.

Withdraw the petition ASAS. Have him file for divorce. If he doesn't know where the woman is he can have an attorney help him file by making an announcement in the newspaper and such. Since she was a friend of his step-fathers he probably knows how to reach her. There could be a problem is she is difficult granting the divorce as she would rock the boat and announce he married her for immigration purposes which might cause a lot of problems for him.

He must withdraw the current application get divorced and start out over. The fact will come to light some day and you will lose all immigration benefits you have gotten based on his fraud.
