Hello all,

I really need some help understanding the point at which we are at. I, USC, my husband UKC applied for K-3, I-130 and I-765. The K-3 was approved in Nov 2004 and we flew to USA in Jan 2005. Jan 25, 2005 his I-130 was approved. In april 2006 he recieved his work permit and SS#. During all this we have yet to file for AOS(long story,money issue) so now he flew back to England Nov. 22,2006 because his daughter was ill and his K-3 expired Nov.29, 2006. So at this point we decided we'll just finish the process from London so he can fly back with PR/GC and were done.

Now we recieved a packet back in April 2005 with this DS-3032 and I-864 Processing Fee Bill which I still have but ignored because we were doing AOS in the states. So I been searching for info for a week or more on how to do this and pulling my hair out, but I finally called the NVC, which by the way are not friendly or helpful, and they told me yes he can do it from london but she couldnt be ask to tell me the process or forms or even a hint of a timeline. What I have found out is reading your posts.

Could any of you please please explain to me where to go from here? This DS-3032 has an expire date of 12/31/2006 on it which is worrying me. Because of the time lapse she said I needed to send a letter telling them we still want to continue with the case. Which I sent at least 2weeks ago but she said they have no record of it and to sent it again and then when they get it they will process it and send out the same thing I got in front of me. Cant I get on with this DS-3032 and I-864 Fee Bill and send another letter again saying we want to continue at the same time to get this moving? Also what is DS-230 package? We have been married for 4-1/2yrs so I know he will get the 10yr, what a nice vacation from this immigration nightmare that will be.

Please guys I would so appreciate your help with any answers you could offer me. thank you

If this is true, I may be mistaken, but I think your husband's case is considered abandoned.

But your post is a bit confusing since you say later you ignored the DS-3032 and I-864 Preocessing fee bill since you "were doing AOS in the states".

Also, you say his K3 visa expired Nov. 29. How could that be? He came to the U.S. Jan. 2005. A K3 visa is only good for six months....

Also, you say his K3 visa expired Nov. 29. How could that be? He came to the U.S. Jan. 2005. A K3 visa is only good for six months....

No NVC told me it is not abandoned and still waiting for us, but I did need to to send a letter stating we still want to finish processing. We ignored the DS-3032 and I-864 fee bill as this is only if your going to do final interview at the US consulate in the country the foreign spouse is from. So we planned on doing AOS in the states so the I-485 would have been the route taken and final interview would have been here at the local INS office so I just put it away in the immigration file till now. His K-3 was good for 2yrs. I dont know anyone that wasnt. The K-1 for marriage I believe is for 6mos. but not the K-3. We were already married for over 2yrs when we recieved the K-3. 6mos would not be enough time to enter the USA and get settled and file for AOS and get paperwork through and get your appoitment and interview before your K-3 expired.

The DS-3032 is the "Choice of Agent and Address Form" Your husband needs to assign a person or lawyer to act on his behalf. Normally you assign a lawyer if you have one or you assign your US resident spouse. Your husband will need to sign and date. If he is in the UK you can fax him a copy. He will need to send to NVC upon completion. Strongly recommend sending overnight.

The I-864 Processing Bill Fee is $70.00. This fee pays for the Affidavit of Support documents they will send you and further process. You will not receive the documents until the fee is paid.

Have you considered contacting the US consulate to find out what your options are. Can your husband get an extension on his K-3?

If I was you I would have my husband submit his choice of agent via email to the NVC and add a note in the email stating that he is planning on pursuing the IR1 through London.
