Dear members...

I have a big issue. My father in law doesnt want to be joint sponsor for my AOS because he thinks that goverment will garnish the rest of income from poverty guidelines from his wage since my husband income is not enough like in standart.

My questin, can i apply ead without filinf aos first? My i-94 exp on jan 19 2014.

Your father in law is simply not correct. He needs to clearly understand the way the 864 could affect him in the future. Key word is could.

As the co sponsor he will provide any support required rather than you asking the U S govt to support you. If you did require the govt to support you he could be asked to pay them back.

If he understands this he could provide the 864 which allows you to file the AOS as well as the EAD which is free if requested with the AOS. Once you get that and go to work he wont have to worry about providing your support. Explain and ask him to reconsider.

No unfortunately you can't.

You need to either convince your father in law, or find another joint sponsor, or your husband needs to get a higher paid or a second job so that he qualifies as sponsor on his own.

We still try to explain. He is a financial aid so he thinks he is correct.

In theory you can but it would only be valid until end of you i-94.

Unfortunately not. If you'd apply at any time after entering on K-1 you could apply for EAD based on K-1 but it would only be valid until i-94 expiration date.

1 year EAD is issued to those who apply concurrently with I-485 (aos).

Even i have married with us citizen? If like that i cant do anything because my father in law doesnt want and my husband is still school ;(.

Why does i cant? Is it because my i-94 is going to exp?

so, you want to file an EAD without filing the AOS set.

As a K-1 visa holder, you are allowed to chase only an EAD, if that's what you want to do,

however,

an EAD filed with your current status (K-1 visa holder) expires when the I-94 expires, and

usually it takes 90 days from filing of paperwork until the card arrives, plus you have to pay the fee.

MOST LIKELY the I-94 expires before you receive the EAD card, so why to even bother?

I want to suggest something else to you. You and your spouse not need to file the big AOS set immediately, so if he gets the big job now and keeps it for a year - hey - file AOS in 2015. Sure, it'll mean you aren't allowed to work, or really participate in USA society (no drivers license) but if Dad is being a butt, keep that in mind - there is no deadline to file the AOS set.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
